Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
DETAILED ACTION
Continued Examination Under 37 CFR 1.114
A request for continued examination under 37 CFR 1.114, including the fee set forth in 37 CFR 1.17(e), was filed in this application after final rejection. Since this application is eligible for continued examination under 37 CFR 1.114, and the fee set forth in 37 CFR 1.17(e) has been timely paid, the finality of the previous Office action has been withdrawn pursuant to 37 CFR 1.114. Applicant's submission filed on 8/7/2026 has been entered.
Rejections and/or objections not reiterated from previous office actions are hereby withdrawn. The following rejections and/or objects are either reiterated or newly applied. They constitute the complete set presently being applied to the instant application.
Allowed Claims
The following is a statement of reasons for the indication of allowable subject matter: The closest prior art is WO 2006/126095 to Hitz (IDS filed 1/26/2021). Although Hitz teaches a copolymer containing multiple molecules of an active agent, comprising polymerization of a reaction mixture comprising (1) one or more polymerizable principal monomers, which monomers are characterized as having at least one vinyiic group and not containing an amino acid residue, such as 2•phenylethylacry1ate and 2-phenylethylmethacrylate (example 20), and 2-hydrmcyethylmethacrylate, and ethylene glycol diacryiate (example 21)); one or more co-principal monomers of formula I or II in which at least one of Y and Zis H (examples 20 and 21); an initiator system for generating free radical species such as dj.{tertbutyk:yclohexyl)perO>tydicarbonate and azobisisobutyronitrile) (examples 20-21), the polymerization yielding a copolymer, coupling of the active agent to the copolymer after polymerization of the reaction mixture (abstract; page 2, first full paragraph to page 7, first full paragraph; Examples 20-22), it fails to teach or fairly suggest the present invention, particularly the combination of the recited structures, targeting moieties, and a radical polymerization agent.
Any comments considered necessary by applicant must be submitted no later than the payment of the issue fee and, to avoid processing delays, should preferably accompany the issue fee. Such submissions should be clearly labeled “Comments on Statement of Reasons for Allowance.”
Claims 1-17 and 20-25 are directed to an allowable product. Pursuant to the procedures set forth in MPEP § 821.04(b), claims 18-19, directed to the process of making or using the allowable product, previously withdrawn from consideration as a result of a restriction requirement, are hereby rejoined and fully examined for patentability under 37 CFR 1.104. Because a claimed invention previously withdrawn from consideration under 37 CFR 1.142 has been rejoined, the restriction requirement between groups I-III as set forth in the Office action mailed on 1/29/2024 is hereby withdrawn. In view of the withdrawal of the restriction requirement as to the rejoined inventions, applicant(s) are advised that if any claim presented in a divisional application is anticipated by, or includes all the limitations of, a claim that is allowable in the present application, such claim may be subject to provisional statutory and/or nonstatutory double patenting rejections over the claims of the instant application.
Once the restriction requirement is withdrawn, the provisions of 35 U.S.C. 121 are no longer applicable. See In re Ziegler, 443 F.2d 1211, 1215, 170 USPQ 129, 131-32 (CCPA 1971). See also MPEP § 804.01.
New Grounds of Rejection
Claim Rejections - 35 USC § 112
The following is a quotation of the first paragraph of 35 U.S.C. 112(a):
(a) IN GENERAL.—The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor or joint inventor of carrying out the invention.
The following is a quotation of the first paragraph of pre-AIA 35 U.S.C. 112:
The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor of carrying out his invention.
Claims 18-19 are rejected under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA ), first paragraph, as failing to comply with the written description requirement. The claim(s) contains subject matter which was not described in the specification in such a way as to reasonably convey to one skilled in the relevant art that the inventor or a joint inventor, or for applications subject to pre-AIA 35 U.S.C. 112, the inventor(s), at the time the application was filed, had possession of the claimed invention. Regarding claim 18, there is no description of what an “effective amount” is within the boundaries of the claim. There is no description of what amounts are and are not “an effective amount” under the scope of the invention. Regarding claim 19, the use of a pharmaceutical composition is not a statutory class of subject matter, and there is no description in the application how to carry out such use.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 18-19 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Regarding claim 18, as there is no description in the application of what an effective amount within the meaning of the invention is, it is unclear what values are encompassed by the claim. Regarding claim 19, as the use of a pharmaceutical composition is not a statutory class of subject matter, it's unclear what statutory class of subject matter is being claimed.
