Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . DETAILED ACTION Response to Amendment The amendment filed on 4/08/2026 has been received and claims 1-2, 4, and 6-22 are pending. Continued Examination Under 37 CFR 1.114 A request for continued examination under 37 CFR 1.114, including the fee set forth in 37 CFR 1.17(e), was filed in this application after final rejection. Since this application is eligible for continued examination under 37 CFR 1.114, and the fee set forth in 37 CFR 1.17(e) has been timely paid, the finality of the previous Office action has been withdrawn pursuant to 37 CFR 1.114. Applicant's submission filed on 4/15/2026 has been entered. Claim Objections Claim 18 is objected to because of the following informalities: in line 2, insert --at least one-- before “flexible”. Appropriate correction is required. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claim 22 is rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. In Claim 22, it is not clear whether the limitation “the interior above the at least one flexible bag assembly” is attempting indicate a region outside the interior of the at least one flexible bag assembly and/or to a region above the at least one flexible bag assembly. Claim 22 recites the limitation "the interior above" in line 3. There is insufficient antecedent basis for this limitation in the claim. Allowable Subject Matter Claims 1-2, 4 and 6-21 are allowed. The following is an examiner’s statement of reasons for allowance: the primary reason for allowance of the claims is due to amendment of the claim to include the limitations that “the first top lid and the second middle lid and the third internal lid rotate about the hinge” and that “the second middle lid and the third internal lid…are stacked concentrically”. While prior art of record such as Yang (20150259140), Parker (20180155123), Michaels (20110017745) and/or Morand (WO2020056523) teaches a receptacle as set forth in paragraph 13 of the Office Action mailed 1/21/2026, none appears to specifically teach a lid assembly with a first top lid and a second middle lid and a third internal lid that rotate about one hinge and are stacked concentrically. It would not have been obvious to one of ordinary skill in the art before the effective filing date of the claimed invention to provide a diaper pail comprised of components in the configuration as set forth in the claims. Any comments considered necessary by applicant must be submitted no later than the payment of the issue fee and, to avoid processing delays, should preferably accompany the issue fee.
