DETAILED ACTION
Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Election/Restrictions
During a telephone conversation with Andrew Young on 07/01/2026 a provisional election was made without traverse to prosecute the invention of the cladding glass of micro channel plate resistant to ion bombardment claims 4 and 11-12. Affirmation of this election must be made by applicant in replying to this Office action. Claims 5-10 are withdrawn from further consideration by the examiner, 37 CFR 1.142(b), as being drawn to a non-elected invention.
Priority
Examiner notes the certified copy of the foreign priority document appears to be missing.
Claim Objections
Claims 4 and 11 are objected to because of the following informalities: claims 4 and 11 at line 1 recite “a cladding glass of microchannel …” which appears as if it should instead recite “a cladding glass of a microchannel …”. Appropriate correction is required.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claim 12 is rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Claim 12 recites the limitation "the glass composition resistant to ion bombardment" in line 1. There is insufficient antecedent basis for this limitation in the claim. Claim 12 depends upon claim 4, which recites “a cladding glass of microchannel plate resistant to ion bombardment”. It appears as if claim 12 should instead recite “the cladding glass of microchannel plate resistant to ion bombardment”.
Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 4 and 11-12 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Cao et al. (CN106746607A with reference to the original Chinese publication, hereinafter referred to as Cao).
Regarding claim 4, Cao discloses a cladding glass of microchannel plate resistant to ion bombardment (see Cao at the Abstract of the machine translation, disclosing a microchannel slab glass), comprising a composition, in terms of mole percentage, comprising: 60 mole% to 78 mole% of SiO2 (see Cao at Example 2 from the Table at [0074] of the original Chinese publication, disclosing an example of a glass comprising 63.0 mol% SiO2); 1 mole% to 6 mole% of Bi2O3 (see Cao at Example 2 from the Table at [0074] of the original Chinese publication, disclosing an example of a glass comprising 1.0 mol% Bi2O3); 5 mole% to 18 mole% of PbO (see Cao at Example 2 from the Table at [0074] of the original Chinese publication, disclosing an example of a glass comprising 12.0 mol% PbO); 5 mole% to 20 mole% of alkali metal oxide (see Cao at Example 2 from the Table at [0074] of the original Chinese publication, disclosing an example of a glass comprising 5.0 mol% Cs2O); 2 mole% to 8 mole% of alkaline-earth metal oxide (see Cao at Example 2 from the Table at [0074] of the original Chinese publication, disclosing an example of a glass comprising 1.0 mol% BaO, 2.5 mol% CaO, and 2.5 mol% SrO, for a total alkaline-earth metal oxide content of 6 mol%); 0.1 mole% to 2.5 mole% of Al2O3 (see Cao at Example 2 from the Table at [0074] of the original Chinese publication, disclosing an example of a glass comprising 2.0 mol% Al2O3); and 3 mole% to 9 mole% of specialty oxide; wherein, the specialty oxide is selected from at least one of Sc2O3, SrO, ZrO2, MoO3 and MoO2 (see Cao at Example 2 from the Table at [0074] of the original Chinese publication, disclosing an example of a glass comprising 2.5 mol% SrO and 1.5 mol% ZrO2 to provide 4 mol% specialty oxide), and 0 mole% to 9 mole% of Sc2O3 (see Cao at Example 2 from the Table at [0074] of the original Chinese publication, disclosing an example of a glass comprising 0% Sc2O3); 0 mole% to 9 mole% of SrO (see Cao at Example 2 from the Table at [0074] of the original Chinese publication, disclosing an example of a glass comprising 2.5 mol% SrO); 0 mole% to 6 mole% of ZrO2 (see Cao at Example 2 from the Table at [0074] of the original Chinese publication, disclosing an example of a glass comprising 1.5 mol% ZrO2); and 0 mole% to 3 mole% of MoO3 and/or MoO2 (see Cao at Example 2 from the Table at [0074] of the original Chinese publication, disclosing an example of a glass comprising 0% MoO3 and MoO2).
Regarding claim 11, Cao discloses the glass composition further comprises a clarifying agent accounting for 0.1% to 0.8% of the total mass of the components (see Cao at Example 2 from the Table at [0074] of the original Chinese publication, disclosing an example of a glass comprising a sum of Sb2O3 and/or As2O3 of 0.2 wt.%).
Regarding claim 12, Cao discloses the alkali metal oxide is selected from at least one of Na2O, K2O and Cs2O (see Cao at Example 2 from the Table at [0074] of the original Chinese publication, disclosing an example of a glass comprising 5.0 mol% Cs2O); the alkaline earth metal oxide is selected from at least one of MgO, BaO and CaO (see Cao at Example 2 from the Table at [0074] of the original Chinese publication, disclosing an example of a glass comprising 1.0 mol% BaO, 2.5 mol% CaO, and 2.5 mol% SrO, for a total alkaline-earth metal oxide content of 6 mol%); and the clarifying agent is Sb2O3 and/or As2O3 (see Cao at Example 2 from the Table at [0074] of the original Chinese publication, disclosing an example of a glass comprising a sum of Sb2O3 and/or As2O3 of 0.2 wt.%).
