DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 10-12, and 15-18 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. In claim 10, it is noted that both the supply port and the input/output port are incorrectly both identified with reference numeral 181. Further, it appears that the input/output port is not clearly identified in the drawing of Figure 2 or the description. Further, on line 6, there appears to be no “means for maintaining constant pressure in the piston accumulator” identified with a reference numeral from the figure 2 embodiment. On lines 13-14, it is unclear how the input/output port 181 is configured to feed gas received at supply port (also 181) to a composite liquid sampling container 202. On lines 19-21, it is unclear how the sample line is identified as 149. The specification identifies the sample line as 146 and 149 is the container line. Further, it appears there is no direct line from the source 102 to the sampling container 202 as indicated in the claim. It would appear the sample proceeds from the accumulator 204. Please note there is no clear connection given between the claimed piston accumulator and the composite liquid sample container. As to claim 18, there is no purge valve 147 identified in the fig. 2 embodiment. Response to Arguments Applicant’s arguments with respect to claim(s) 10-12, and 15-18 have been considered but are moot because the new ground of rejection does not rely on any reference applied in the prior rejection of record for any teaching or matter specifically challenged in the argument. Allowable Subject Matter Claims 10-12, and 15-18 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action.
