DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 112 Claims 1-8 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Claims 1-8 are narrative in form. Correction is required. Regarding Claims 1-6, 8, the claims result in the assigning of parameters to operation elements, but do not result in “effect adding” as recited in the preambles. Correction is required. Regarding Claims 1-8, are the “designated effects” the same as the “plurality of effects”? It is unclear as to what is meant by “used in combination” when it comes to the ‘effects.’ Are the “other effects” part of the “plurality of effects,” as it is not clearly set forth. Correction is required. Allowable Subject Matter Claims 1-8 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action. The following is a statement of reasons for the indication of allowable subject matter: claims 1-8 are allowable over the prior art, as the prior art does not explicitly teach that when a plurality of effects including a first effect are to be used in combination, at least one processor executes control to change parameters to be assigned to a plurality of first operation elements among a plurality of parameters corresponding to the first effect in response to a change in other effects to be combined with the first effect. The closest prior art, exemplified by Aiso, Homburg, Maruyama, and Evans, disclose the selection of a parameter to be assigned to operation elements among a plurality of parameters. Conclusion The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. The references cited show related teachings in the art.
