Office Action

§112
DETAILED ACTION The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Continued Examination Under 37 CFR 1.114 A request for continued examination under 37 CFR 1.114, including the fee set forth in 37 CFR 1.17(e), was filed in this application after final rejection. Since this application is eligible for continued examination under 37 CFR 1.114, and the fee set forth in 37 CFR 1.17(e) has been timely paid, the finality of the previous Office action has been withdrawn pursuant to 37 CFR 1.114. Applicant's submission filed on 10/28/2025 has been entered. Claims 1, 3, 10, 15, 21, 27, 24, 25 and 27 are amended. Claim 28 is new. Claims 1-28 are remaining in the application. The previously filed Drawings are accepted. The previously filed Specification is accepted. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. Claim 25 is rejected under 35 U.S.C. 112(b) as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor regards as the invention. The claimed limitation “the at least one tube” in amended dependent claim 25 lacks sufficient antecedent basis (claim 25 is dependent on claim 23 and not claim 24; it is claim 24 where “at least one tube” is first recited in the claims). Allowable Subject Matter Claims 1-24 and 26-28 are allowed. Claim 25 would be allowable if rewritten to overcome the rejection(s) under 35 U.S.C. 112(b) set forth in this Office action and to include all of the limitations of the base claim and any intervening claims. Response to Amendment 13. Applicant's amendments and remarks are deemed sufficient to overcome the previous prior art rejection(s) as presented in the Final Office Action mailed on 04/29/2025. Conclusion 14. Any inquiry concerning this communication or earlier communications from the examiner should be directed to DANIEL V VENNE whose telephone number is (571)272-7947. The examiner can normally be reached between M-F, 7am-3:30pm Flex.
