Election/Restrictions
Applicant's election with traverse of Species III, Figures 4A-4B in the reply filed on 2/03/2025 is acknowledged. The traversal is on the ground(s) that claims 1-3, 6-7, 10-11This is not found persuasive because claim 1, as amended, requires “a center post having a plurality of post pieces, each post piece having (i) a thickness contributing to a height of the center post, (ii) a radial extent, and (iii) at least one first notch disposed in the post piece and occupying the entire radial extent of the post piece, and a backplate having (a) a plurality of magnetic material members extending radially between the center post and the outer rim; and b) a plurality of radially disposed notches, wherein each of the notches of the backplate is wedge-shaped and has a width that increases with increased distance from the center post” do not read on elected Species III of Figures 4A-4B. Claims 6-7 and 10-11 will be withdrawn. Claim 14 is canceled, per amendment. Claim 16, as amended, requires “the first angular location matches the third angular location, and the second angular location differs from the first angular location” do not read on the elected Species III of Figures 4A-4B. Claims 12, 21 and 44 will be examined herewith.
The requirement is still deemed proper and is therefore made FINAL.
Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention.
Claim(s) 12, 21 and 44 is/are rejected under 35 U.S.C. 102(a)(2) as being anticipated by Uematsu et al. [JP 2000-040626 A].
Regarding claim 12, Uematsu et al. discloses an apparatus [figure 94], comprising:
a magnetic core, comprising:
A) a center post [part of hole 11] defining a central axis and having at least one first notch [figure 94], radially disposed therein, that defines a first angular location about the central axis;
B) an outer rim [31] having at least one second notch [figure 94], radially disposed therein, that defines a second angular location about the central axis; and
C) a backplate [bottom part of core 10, figure 94] having at least one third notch, radially disposed therein, that defines a third angular location about the central axis; wherein the first angular location differs from at least one of the second angular location and the third angular location [figure 94].
Regarding claim 21, Uematsu et al. further discloses a winding [42a, 42b] magnetically coupled to the magnetic core.
Regarding claim 44, Uematsu et al. discloses an apparatus [figure 94], comprising:
a magnetic core [10], comprising:
a center post [part of hole 11];
an outer rim [31];
a backplate [bottom part of core 10]; and
at least two notches selected from the group consisting of: a first notch in the center post [figure 94], a second notch in the outer rim [figure 94], and a third notch in the backplate [figure 94], wherein the at least two notches occupy distinct angular locations [figure 94], and wherein a combination of the at least two notches reduces or eliminates dimensional resonance.
Response to Arguments
Applicant’s arguments with respect to claim(s) 12, 21 and 44 have been considered but are moot because the new ground of rejection does not rely on any reference applied in the prior rejection of record for any teaching or matter specifically challenged in the argument.
