Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Status of the claims
Claims 1, 24, 26-28, 36-37, and 65-77 are pending and examined herein to the extent that they read on the elected species (i.e. cis-abienol synthase, SEQ ID NOs: 4-5, 25-26, and 46-47).
All rejections of claims 17 and 19 are moot in light of Applicant’s cancellation of the claims.
The rejection of claims 1, 24, 26-28, 36-37, and 65, 68-69 and 72 under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA ), first paragraph, as failing to comply with the written description requirement is withdrawn in light of Applicant’s amendment of the claims.
Examiner notes that all of SEQ ID NOs: 106 to 111 and 206 to 208 have been rejoined.
Terminal Disclaimer
The terminal disclaimer filed on 17 November 2025 disclaiming the terminal portion of any patent granted on this application which would extend beyond the expiration date of US Patent No. 12,351,809 has been reviewed and is accepted. The terminal disclaimer has been recorded.
Status of the claims
The rejection of claims 24 and 26 under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention, is withdrawn in light of Applicant’s amendment of the claims.
The rejection of claims 1, 24, 26-28, 36-37, and 65-72 under 35 U.S.C. 103 as being unpatentable over Rontein et al (FR2903703A1) in view of in view of Wagner et al (US. Patent No.: 7,501,557; issued 10 March 2009) and Lewis et al (US Patent No. 9,603,335 B2; issued 29 March 2017) has been withdrawn in light of Applicant’s amendment of the claims.
The rejection of claims 1, 24, 26-28, 36-37, and 65-72 on the ground of nonstatutory double patenting as being unpatentable over claim 1-3, 5-11, and 14-18 of U.S. Patent No. 12,351,809 (hereafter ‘809) in view of Rontein et al (FR2903703A1) has been withdrawn in light of the terminal disclaimer filed by Applicant on 17 November 2025.
Double Patenting
The nonstatutory double patenting rejection is based on a judicially created doctrine grounded in public policy (a policy reflected in the statute) so as to prevent the unjustified or improper timewise extension of the “right to exclude” granted by a patent and to prevent possible harassment by multiple assignees. A nonstatutory double patenting rejection is appropriate where the conflicting claims are not identical, but at least one examined application claim is not patentably distinct from the reference claim(s) because the examined application claim is either anticipated by, or would have been obvious over, the reference claim(s). See, e.g., In re Berg, 140 F.3d 1428, 46 USPQ2d 1226 (Fed. Cir. 1998); In re Goodman, 11 F.3d 1046, 29 USPQ2d 2010 (Fed. Cir. 1993); In re Longi, 759 F.2d 887, 225 USPQ 645 (Fed. Cir. 1985); In re Van Ornum, 686 F.2d 937, 214 USPQ 761 (CCPA 1982); In re Vogel, 422 F.2d 438, 164 USPQ 619 (CCPA 1970); In re Thorington, 418 F.2d 528, 163 USPQ 644 (CCPA 1969).
A timely filed terminal disclaimer in compliance with 37 CFR 1.321(c) or 1.321(d) may be used to overcome an actual or provisional rejection based on nonstatutory double patenting provided the reference application or patent either is shown to be commonly owned with the examined application, or claims an invention made as a result of activities undertaken within the scope of a joint research agreement. See MPEP § 717.02 for applications subject to examination under the first inventor to file provisions of the AIA as explained in MPEP § 2159. See MPEP § 2146 et seq. for applications not subject to examination under the first inventor to file provisions of the AIA . A terminal disclaimer must be signed in compliance with 37 CFR 1.321(b).
The filing of a terminal disclaimer by itself is not a complete reply to a nonstatutory double patenting (NSDP) rejection. A complete reply requires that the terminal disclaimer be accompanied by a reply requesting reconsideration of the prior Office action. Even where the NSDP rejection is provisional the reply must be complete. See MPEP § 804, subsection I.B.1. For a reply to a non-final Office action, see 37 CFR 1.111(a). For a reply to final Office action, see 37 CFR 1.113(c). A request for reconsideration while not provided for in 37 CFR 1.113(c) may be filed after final for consideration. See MPEP §§ 706.07(e) and 714.13.

Claims 1, 24, 26-28, 36-37, and 65-77 are provisionally rejected on the ground of nonstatutory double patenting as being unpatentable over claim 41-56 of copending Application No. 19/225,122 (hereafter ‘122) in view of Rontein et al (FR2903703A1).
This is a provisional nonstatutory double patenting rejection.
Claims 41-60 of copending application ‘122 are broadly drawn to tobacco material from a modified tobacco plant, comprising a recombinant nucleic acid molecule comprising a heterologous promoter operably linked to a nucleotide encoding a polypeptide, wherein the promoter has 95%, 98% or 100% identity to SEQ ID NOs: 46 or 47 (claim 41-43); said tobacco material from a modified plant wherein the plant variety is flue-cured variety, a bright variety, a Burley variety, a Virginia variety, a Maryland variety, a dark variety, a Galpão variety, an Oriental variety, and a Turkish variety, and any one of a number of specific varieties (claims 52-55); the tobacco material from a modified plant of claim 41 wherein the nucleotide encoding a polypeptide encodes an amino acid with 95% or 100% sequence identity to one of SEQ ID NO: 18-26 or 64-79 (claims 44-45); the tobacco material from a modified plant of claim 41 wherein the nucleotide encoding a polypeptide has 95% or 100% sequence identity to one of SEQ ID NO: 27-35 or 48 to 63 (claims 46-47); the tobacco material from a modified plant of claim 41 wherein the polypeptide is involved in biosynthesis of at least one terpene (claim 48); wherein the at least one terpene is cis-abienol (claim 49); wherein the terpene is cis-abienol synthase ISOFORM1 or ISOFORM2 (claims 50-51); the tobacco material from a modified plant of claim 41 wherein the plant is a male sterile tobacco plant or a cytoplasmically male sterile tobacco plant (claim 56).
The instant claims are broadly drawn to modified tobacco or cannabis plants comprising a nucleic acid sequence encoding a cis-abienol synthase polypeptide operably linked to a heterologous promoter and wherein the polypeptide comprises the sequence of SEQ ID NO: 46 (i.e. cis-abienol synthase ISOFORM 1) or 47 (i.e. cis-abienol synthase ISOFORM 2) and wherein the promoter comprises a sequence with at least 99% sequence identity to a sequence selected from the group consisting of SEQ ID NOs: 106-111 and 206-208; said plant wherein the nucleic acid sequence comprises the sequence of SEQ ID NO: 4 or 5; said plant wherein the plant comprises an increased amount of at least one terpene compared to a non-modified plant, wherein the increase is at least 5% and wherein the terpene is neophytadiene. The claims are further drawn to said modified tobacco or cannabis plant wherein the plant wherein the nucleic acid sequence comprises the sequence of SEQ ID NOs: 26 or 27.
The claims are further drawn to the modified tobacco plant of claim 1, wherein the tobacco plant is selected from a flue-cured variety, a bright variety, a Burley variety, a Virginia variety, a Maryland variety, a dark variety, a Galpao variety, an Oriental variety ,and a Turkish variety; a cured tobacco product of the plant of claim 1, and wherein the curing is flue curing, air curing, fire, curing, or sun curing and the plant of claim 1, wherein the plant is a male sterile tobacco plant or a cytoplasmically male sterile tobacco plant.
Instant SEQ ID NOs: 207 and 208 have 100% identity to the trichome specific promoters encoded by SEQ ID NOs: 46 and 47 of copending application ‘122 (see Specification of ‘122, Examples 3-6 for disclosures relating to promoter specificity):

Rontein et al teaches a tobacco plant comprising an expression cassette comprising a gene encoding a cis-abienol synthase polypeptide comprising a sequence with 100% identity to instant SEQ ID NO: 46 and encoded by a polynucleotide with 100% sequence identity to instant SEQ ID NO: 4; operably linked to a heterologous promoter (claims 1-5, 9-10; Figure 3).
Rontein teaches that is preferable to use a tissue specific promoter, such as a tobacco trichome specific promoter (pages 17-18; Figure 3).
Therefore, it would be obvious to combine the claims of ‘122 into a single embodiment as required by the claims of the instant application.
This is a provisional nonstatutory double patenting rejection.
