Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . DETAILED ACTION Status of Application/Amendment/Claims Applicant's response filed 12/16/2025 has been considered. Rejections and/or objections not reiterated from the previous office action mailed 09/17/2025 are hereby withdrawn. The following rejections and/or objections are either newly applied or are reiterated and are the only rejections and/or objections presently applied to the instant application. The text of those sections of Title 35, U.S. Code not included in this action can be found in a prior Office action. With entry of the amendment filed on 12/16/2025, claims 1-5, 7-9, 15, 17-28 are pending. Claims 1-5, 7-9, 15, 17-23 and 26-28 are currently under examination. Claims 24 and 25 are withdrawn from further consideration pursuant to 37 CFR 1.142(b) as being drawn to a nonelected invention, there being no allowable generic or linking claim. Structures having formula (I-A) and formula (I-B) are free of the prior art searched. WO 2017066793 is the closest prior art describing a nucleotide analog on page 2 but does not specifically describe the instant formula (I-A) and formula (I-B) and does not make it obvious to try making the instantly claimed formula or attach to a dsRNA. The 112(a) enablement rejection is withdrawn in view of the new rejection below necessitated by claim amendments. Claim Rejections - 35 USC § 112 – necessitated by claim amendments The following is a quotation of 35 U.S.C. 112(a): (a) IN GENERAL.—The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor or joint inventor of carrying out the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), first paragraph: The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same and shall set forth the best mode contemplated by the inventor of carrying out his invention. Claim 27 is rejected under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA ), first paragraph, as failing to comply with the enablement requirement. The claim(s) contains subject matter which was not described in the specification in such a way as to enable one skilled in the art to which it pertains, or with which it is most nearly connected, to make and/or use the invention. The following factors have been considered in the analysis of enablement: (1) the breadth of the claims, (2) the nature of the invention, (3) the state of the prior art, (4) the level of one of ordinary skill, (5) the level of predictability in the art, (6) the amount of direction provided by the inventor, (7) the existence of working examples, (8) the quantity of experimentation needed to make or use the invention based on the content of the disclosure. The breadth of the claims and nature of the invention: Claim 27 has been amended to a method for treating a transthyretin (TTR) gene-mediated disease or disorder comprising administering an effective amount of the double-stranded oligonucleotide of claim 1. The nature of the invention relies on treating any disease or disorder mediated by TTR using a double-stranded oligonucleotide having any nucleotide sequence that targets any gene with the function of mediating a TTR mediated disease. Whether the specification would have been enabling as of the filing date involves consideration of the nature of the invention, the state of the prior art, and the level of skill in the art. The state of the prior art is what one skilled in the art would have known, at the time the application was filed, about the subject matter to which the claimed invention pertains. The relative skill of those in the art refers to the skill of those in the art in relation to the subject matter to which the claimed invention pertains at the time the application was filed. See MPEP § 2164.05(b). The state of the prior art provides evidence for the degree of predictability in the art and is related to the amount of direction or guidance needed in the specification as filed to meet the enablement requirement. The state of the prior art is also related to the need for working examples in the specification. The state of the prior art: The prior art of Bettencourt et al. (US 20170307608) teach TTR is a tetrameric protein produced primarily in the liver. Mutations in the TTR gene destabilize the protein tetramer, leading to misfolding of monomers and aggregation into TTR amyloid fibrils (ATTR) and over 100 reported TTR mutations exhibit a spectrum of disease symptoms (0002). Bettencourt et al. teach TTR amyloidosis manifests in various forms. When the peripheral nervous system is affected more prominently, the disease is termed familial amyloidotic polyneuropathy (FAP). When the heart is primarily involved but the nervous system is not, the disease is called familial amyloidotic cardiomyopathy (FAC). A third major type of TTR amyloidosis is called leptomeningeal/CNS (Central Nervous System) amyloidosis (0003). Thus the prior art teach TTR gene mutations can mediate many different types of diseases and disorders. Bettencourt et al. teach dsRNA targeted to a TTR gene that is capable of reducing a neurological impairment is subjects (Example 3). As stated previously, Pei et al. ("On the art of identifying effective and specific siRNAs." Nature methods 3.9 (2006): 670-676) teach while there are siRNA sequence selection web tools for selection of sequences against a gene of interest are known (see Table 1), determination of the precise level of gene knockdown for each siRNA is a demanding process (see page 671 last para). Pei et al. teach there are guidelines that increase the likelihood of identifying effective and specific siRNAs but these guidelines may eliminate potentially functional and specific siRNAs and identified siRNAs still need to be experimentally validated to identify potent and specific siRNAs for any given target (see last para). A review of the prior art does not provide a correlation between targeting any gene comprising a dsRNA comprising the claimed nucleotide analog and treatment of a TTR gene-mediated disease. The prior art does not teach the predictability of identifying potent dsRNA comprising the claimed nucleotide analog and targeted to any gene that is capable of treating any TTR gene-mediated disease given TTR is shown to mediated numerous different types of diseases and disorders. The level of one of ordinary skill: While the level of one of ordinary skill practicing said invention would be high, the level of predictability is considered variable as evident in the prior art discussed above and is not considered to provide sufficient enablement to practice the claimed invention. Because the state of the prior art does not provide evidence of the degree of predictability that using any double-stranded oligonucleotide comprising any of the claimed nucleotide analogs and methods of treatment of any target gene-mediated disease or disorder, one of ordinary skill in the art would look for guidance or direction in the instant specification. The level of predictability in the art: “The “predictability or lack thereof” in the art refers to the ability of one skilled in the art to extrapolate the disclosed or known results to the claimed invention. If one skilled in the art can readily anticipate the effect of a change within the subject matter to which the claimed invention pertains, then there is predictability in the art. On the other hand, if one skilled in the art cannot readily anticipate the effect of a change within the subject matter to which that claimed invention pertains, then there is lack of predictability in the art. Accordingly, what is known in the art provides evidence as to the question of predictability.” (MPEP 2164.03). In this case, one of skill in the art cannot readily anticipate the methods of treatment of any type of TTR gene-mediated disease or disorder from using the claimed double-stranded oligonucleotide targeted to any gene, as broadly claimed. The amount of direction provided by the inventor: The amount of guidance or direction needed to enable the invention is inversely related to the amount of knowledge in the state of the art as well as the predictability in the art. In re Fisher, 427 F.2d 833, 839, 166 USPQ 18, 24 (CCPA 1970). The “amount of guidance or direction” refers to that information in the application, as originally filed, that teaches exactly how to make or use the invention. The more that is known in the prior art about the nature of the invention, how to make, and how to use the invention, and the more predictable the art is, the less information needs to be explicitly stated in the specification. In contrast, if little is known in the prior art about the nature of the invention and the art is unpredictable, the specification would need more detail as to how to make and use the invention in order to be enabling. >See, e.g., Chiron Corp. v. Genentech Inc., 363 F.3d 1247, 1254, 70 USPQ2d 1321, 1326 (Fed. Cir. 2004). The existence of working examples: The working embodiment in the instant application describes using siRNA comprising nucleotide analogs of IgT3 and IgT7 that target a TTR gene and reduce expression in vivo (see Example 1). The working embodiments do not describe how these siRNA targeted to any gene that can treat any TTR gene-mediated disease or disorder in a subject as instantly claimed. The standard of an enabling disclosure is not the ability to make and test if the invention works but one of the ability to make and use with a reasonable expectation of success. A patent is granted for a completed invention, not the general suggestion of an idea (MPEP 2164.03 and Chiron Corp. v. Genentech Inc., 363 F.3d 1247, 1254, 70 USPQ2d 1321, 1325-26 (Fed. Cir. 2004). The instant invention suggests administration of any siRNA sequence comprising any of the vast number of nucleotide analogs to treat any gene-mediated disease or disorder without an enabling disclosure or guidance in the prior art. While the MPEP 2164.02 states the specification need not contain an example if the invention is otherwise disclosed in such manner that one skilled in the art will be able to practice it without an undue amount of experimentation. In re Borkowski, 422 F.2d 904, 908, 164 USPQ 642, 645 (CCPA 1970), the lack of a working example, however, is a factor to be considered, especially in a case involving an unpredictable and undeveloped art. The quantity of experimentation needed to make or use the invention based on the content of the disclosure: The prior art is undeveloped for the role any siRNA sequence comprising said nucleotide analogs targeted to any gene plays in any type of TTR gene-mediated disease or disorder. The specification does not provide sufficient guidance on using any of the vast sequences of siRNA encompassed by the claims. For an enabling disclosure, one of skill in the art must be able to make and use the invention with a reasonable expectation of success and not to make and test if the invention actually works. A patent is granted for a completed invention, not the general suggestion of an idea (MPEP 2164.03 and Chiron Corp. v. Genentech Inc., 363 F.3d 1247, 1254, 70 USPQ2d 1321, 1325-26 (Fed. Cir. 2004). Without further guidance, one of skill in the art would have to practice a substantial amount of trial and error experimentation, an amount considered undue and not routine, to practice the instantly claimed invention. Maintained Rejections Double Patenting The nonstatutory double patenting rejection is based on a judicially created doctrine grounded in public policy (a policy reflected in the statute) so as to prevent the unjustified or improper timewise extension of the "right to exclude" granted by a patent and to prevent possible harassment by multiple assignees. See In re Goodman, 11 F.3d 1046, 29 USPQ2d 2010 (Fed. Cir. 1993); In re Longi, 759 F.2d 887, 225 USPQ 645 (Fed. Cir. 1985); In re Van Ornum, 686 F.2d 937, 214 USPQ 761 (CCPA 1982); In re Vogel, 422 F.2d 438, 164 USPQ 619 (CCPA 1970);and, In re Thorington, 418 F.2d 528, 163 USPQ 644 (CCPA 1969). A timely filed terminal disclaimer in compliance with 37 CFR 1.321(c) or 1.321(d) may be used to overcome an actual or provisional rejection based on a nonstatutory double patenting ground provided the reference application or patent either is shown to be commonly owned with this application, or claims an invention made as a result of activities undertaken within the scope of a joint research agreement. See MPEP § 717.02 for applications subject to examination under the first inventor to file provisions of the AIA as explained in MPEP § 2159. See MPEP §§ 706.02(l)(1) - 706.02(l)(3) for applications not subject to examination under the first inventor to file provisions of the AIA . Claims 1-5, 7-9, 15, 17-23 and 26-28 are rejected under the judicially created doctrine of obviousness-type double patenting as being unpatentable over claims 1, 3-11, 12, 22, 31, 32, 35, 36, 44 of Patent Application 18,532,319. Although the conflicting claims are not identical, they are not patentably distinct from each other because the instant claims and the claims of the patent are drawn to patently indistinguishable subject matter. Claims of App ‘319 are drawn to a compound of formula (I) and an oligonucleotide comprising a compound of formula II which is identical to the instantly claimed compound comprised with the oligonucleotide. For the compound of App ‘319, it would have been obvious to use that in the claimed oligonucleotide. The specification of App ‘319 describes using the compound in siRNA to improve stability and delivery to target cells (see pages 3-4). MPEP 804 “A nonstatutory double patenting rejection is appropriate where the conflicting claims are not identical, but at least one examined application claim is not patentably distinct from the reference claim(s) because the examined application claim is either anticipated by, or would have been obvious over, the reference claim(s). See, e.g., In re Berg, 140 F.3d 1428, 46 USPQ2d 1226 (Fed. Cir. 1998); In re Goodman, 11 F.3d 1046, 29 USPQ2d 2010 (Fed. Cir. 1993); In re Longi, 759 F.2d 887, 225 USPQ 645 (Fed. Cir. 1985). In determining whether a nonstatutory basis exists for a double patenting rejection, the first question to be asked is: Is any invention claimed in the application anticipated by, or an obvious variation of, an invention claimed in the patent? If the answer is yes, then a nonstatutory double patenting rejection may be appropriate.” “The specification can be used as a dictionary to learn the meaning of a term in the claim. Toro Co. v. White Consol. Indus., Inc., 199 F.3d 1295, 1299, 53 USPQ2d 1065, 1067 (Fed. Cir. 1999) ("[W]ords in patent claims are given their ordinary meaning in the usage of the field of the invention, unless the text of the patent makes clear that a word was used with a special meaning.")”. Claims 1-5, 7-9, 15, 17-23 and 26-28 are rejected under the judicially created doctrine of obviousness-type double patenting as being unpatentable over claims 20 and 21 of Patent Application 18,248,982. Although the conflicting claims are not identical, they are not patentably distinct from each other because the instant claims and the claims of the patent are drawn to patently indistinguishable subject matter. Claims of App ‘982 are drawn to a compound of formula (I) and an oligonucleotide comprising a compound of formula II which overlaps in scope to the instantly claimed compound comprised with the oligonucleotide and to methods of treatment. For the compound of App ‘988, it would have been obvious to use that in the claimed oligonucleotide. The specification of App ‘319 describes using the compound in siRNA to improve stability and delivery to target cells (see pages 3-4). MPEP 804 “A nonstatutory double patenting rejection is appropriate where the conflicting claims are not identical, but at least one examined application claim is not patentably distinct from the reference claim(s) because the examined application claim is either anticipated by, or would have been obvious over, the reference claim(s). Applicant’s argument Acknowledgement is made of Applicant's request that the rejection be held in abeyance until allowable matter is indicted in the instant claims, therefore the rejections are maintained. Conclusion Applicant's amendment necessitated the new ground(s) of rejection presented in this Office action. Accordingly, THIS ACTION IS MADE FINAL.
