Office Action

§112
DETAILED ACTION Status of Claims Claims 1, 4, 9-12, 21, 23-24, 28-30, 32, 34, and 36-38 are currently pending in the application. Receipt is acknowledged of Applicant’s response / amendment filed on December 22, 2025 and that has been entered. Response to Arguments Previous Claim Rejections - 35 U.S.C. § 112 (b) Applicant’s response and amendments / arguments [to withdrawal of the rejection of claims 6 and 12 under U.S.C. § 112(b)] have been fully considered and found persuasive with respect to the above rejection and the rejection is hereby withdrawn. Previous Claim Rejections - 35 U.S.C. § 112 (a) Applicant’s response and amendments / arguments [to withdrawal of the rejection / objection of claims 1, 3-4, 6, 8-14, and 21 under U.S.C. § 112(a)] have been fully considered and found persuasive with respect to the above rejection and the rejection is hereby withdrawn. However, upon further consideration of claims amendments, which necessitated the new ground of rejection and therefore, Applicants arguments are rendered moot in view of the present Office Action. Claim Rejections - 35 USC § 112 The following is a quotation of the first paragraph of 35 U.S.C. 112(a): (a) IN GENERAL.—The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor or joint inventor of carrying out the invention. The following is a quotation of the first paragraph of pre-AIA 35 U.S.C. 112: The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor of carrying out his invention. Claims 1, 4, 9-12, and 21 are rejected under 35 U.S.C. § 112, first paragraph, as failing to comply with the written description requirement. The claim(s) contains subject matter, which was not described in the specification in such a way as to reasonably convey to one skilled in the relevant art that the inventor(s), at the time the application was filed, had possession of the claimed invention. The claims contain the subject matter of a newly introduced derivative such as, “a PNG media_image1.png 442 634 media_image1.png Greyscale ” [claim 1 (Currently Amended), page 2, lines 4-12] to overcome the objection / rejection. This subject matter is considered new matter, since the specification and the originally filed claims excluded these subject matters from the compounds as documented by original claims 1, 3-4, 6, 8-14, and 21 and/or in the specification of pages 1-37. The amendment changes the scope of the claims to include “a compound of Formula (II)” that was not previously included in the invention. This rejection can be overcome by deleting the new matter from the instant claims and/or amend the claims within the context and scope of the claims in order to overcome the rejection. Therefore, THIS ACTION IS MADE FINAL. See MPEP § 706.07(a). Applicant is reminded of the extension of time policy as set forth in 37 CFR 1.136(a). A shortened statutory period for reply to this final action is set to expire THREE MONTHS from the mailing date of this action. In the event a first reply is filed within TWO MONTHS of the mailing date of this final action and the advisory action is not mailed until after the end of the THREE-MONTH shortened statutory period, then the shortened statutory period will expire on the date the advisory action is mailed, and any extension fee pursuant to 37 CFR 1.136(a) will be calculated from the mailing date of the advisory action. In no event, however, will the statutory period for reply expire later than SIX MONTHS from the date of this final action.
