New Rejections
Claim Rejections - 35 USC § 112
The text of those sections of Title 35, U.S. Code not included in this action can be found in a prior Office action.
Claims 1, 3-4, 6-12 are rejected under 35 U.S.C. 112(b) as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor regards as the invention.
It is unclear in lines 1-2 of claim 1, what are all the chemical structures that represent the linear fluorinated and non-fluorinated polyurethane (meth)acrylates, because there is not even a general formula representation in the claim, for each of the two groups of linear fluorinated polyurethane (meth)acrylates, and non-fluorinated polyurethane (meth)acrylates.
It is also unclear in lines 6-7, what are all the chemical structures of the “intermediate X” which, while it can be (i) a hydroxy-terminated (per)fluoropolyether (X1), (ii) a reaction product X2 of a PFPE diol with polyisocyanate A and acid-functional polyol C under urethane formation conditions, or (iii) a reaction product X3 of a PFPE diol with polyisocyanate A, a multi-unsaturated OH-functional compound B and an acid-functional polyol under urethane formation conditions, there is not even a general formula representation in the claim, for said intermediate X.
Since the term “comprising” in line 3 is open-ended, it is also unclear what other steps are involved in the method, that would change the chemical structures of the linear fluorinated and non-fluorinated polyurethane (meth)acrylates.
Claims 3-4, 6-12 depend on, and contain all the subject matter of claim 1, but fail to provide any solutions for the indefinite issues described above.
