DETAILED ACTION Notice of Pre-AIA or AIA Status The present application is being examined under the pre-AIA first to invent provisions. Election/Restrictions Applicant’s election without traverse of Group I, claims 1-3, 5 and 10, in the reply filed on July 15, 2025 is acknowledged. Claims 6-9 are withdrawn from further consideration pursuant to 37 CFR 1.142(b) as being drawn to nonelected inventions, there being no allowable generic or linking claim. Election was made without traverse in the reply filed on July 15, 2025. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 1-3 and 5 rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. A broad range or limitation together with a narrow range or limitation that falls within the broad range or limitation (in the same claim) may be considered indefinite if the resulting claim does not clearly set forth the metes and bounds of the patent protection desired. See MPEP § 2173.05(c). In the present instance, claim 1 recites the broad recitation of forming the external electrode layer by either vapor phase physical or chemical deposition techniques, and the claim also recites forming the external electrode by microwave-assisted chemical vapor deposition which is the narrower statement of the range/limitation. The claim(s) are considered indefinite because there is a question or doubt as to whether the feature introduced by such narrower language is (a) merely exemplary of the remainder of the claim, and therefore not required, or (b) a required feature of the claims. The following is a quotation of 35 U.S.C. 112(d): (d) REFERENCE IN DEPENDENT FORMS.—Subject to subsection (e), a claim in dependent form shall contain a reference to a claim previously set forth and then specify a further limitation of the subject matter claimed. A claim in dependent form shall be construed to incorporate by reference all the limitations of the claim to which it refers. The following is a quotation of pre-AIA 35 U.S.C. 112, fourth paragraph: Subject to the following paragraph [i.e., the fifth paragraph of pre-AIA 35 U.S.C. 112], a claim in dependent form shall contain a reference to a claim previously set forth and then specify a further limitation of the subject matter claimed. A claim in dependent form shall be construed to incorporate by reference all the limitations of the claim to which it refers. Claim 2 is rejected under 35 U.S.C. 112(d) or pre-AIA 35 U.S.C. 112, 4th paragraph, as being of improper dependent form for failing to further limit the subject matter of the claim upon which it depends, or for failing to include all the limitations of the claim upon which it depends. Claim 2 fails to further limit because it requires an alternative material for the external electrode layer which is different from the material required by parent claim 1. Parent claim 1 requires that the external electrode layer is formed from boron-doped diamond while dependent claim 2 requires that the external electrode layer comprises at least one element selected from the group consisting of Pt, Pd, Ir, Ru, Rh, Nb and Ti. Page 6 of the specification of the present application as originally filed discloses that these two types of external electrode layers are different embodiments. Applicant may cancel the claim(s), amend the claim(s) to place the claim(s) in proper dependent form, rewrite the claim(s) in independent form, or present a sufficient showing that the dependent claim(s) complies with the statutory requirements. Allowable Subject Matter Claim 10 is allowed. Claims 1-3 and 5 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action. The following is a statement of reasons for the indication of allowable subject matter: Freeman (U.S. Patent Publication No. 2012/0024571) teaches a method for forming an electrode assembly having an interdigitated structure of electrodes (Abstract and Page 7 Paragraph 0119). Freeman teaches an embodiment wherein a substrate was provided with a silicon oxide layer on its surface followed by depositing a conductive layer on the silicon oxide layer (Page 6 Paragraph 0099). After depositing the conductive layer digits were formed through a lithographic technique (page 6 Paragraph 0099). However, in the case of claim 1, Freeman does not fairly teach or suggest having provided a lithographically-patterned substrate consisting of an interdigitated surface by a lithographic technique prior to applying an external electrode comprising a boron-doped diamond film formed by microwave assisted chemical vapor deposition. In the case of claim 10, Freeman does not fairly teach or suggest having applied a laser technique to obtain a multiplicity of finger shaped anodic and cathodic microelectrodes being mutually intercalated at an inter-anodic-cathodic gap lower than 100 micrometers and having an average surface roughness lower than 0.05 micrometers. Conclusion Claim 10 has been allowed and claims 1 through 3 and 5 are rejected. Claims 6 through 9 have been withdrawn.
