Response to Arguments Applicant's arguments filed 09/18/2025 have been fully considered but they are not persuasive. The reference of Sakhnini et al., (USPat. App. Pub. No. 2022/0014328 already an issue Patent US 12301486 B2 with an effectively filed date of 07/13/2020. Furthermore, the inventive entity between the instant application (SAKHNINI, Iyab Issam; LUO, Tao; ZHOU, Yan), and the US Patent to Sakhnini (SAKHNINI, Iyab Issam; LUO, Tao; ZHOU, Yan; MONTOJO, Juan; CHEN, Wanshi) are considered different. The issue patent US 12301486 B2 is considered to be prior art to the instant application. The rejection to the claims stands as follows. Claim Rejections - 35 USC § 103 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action: A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made. The text of those sections of Title 35, U.S. Code not included in this action can be found in a prior Office action. The factual inquiries for establishing a background for determining obviousness under 35 U.S.C. 103 are summarized as follows: 1. Determining the scope and contents of the prior art. 2. Ascertaining the differences between the prior art and the claims at issue. 3. Resolving the level of ordinary skill in the pertinent art. 4. Considering objective evidence present in the application indicating obviousness or nonobviousness. Claim(s) 1, 4, 5, 8, 9, 12-14, 21, 23, 24, 26, 28, 30, 31, 34, 35, 38, and 39 are rejected under 35 U.S.C. 103 as being unpatentable over US-20190082363 A1 to Park et al., from hereon Park-363 in view of US 20220014328 A1 to Sakhnini et al., from hereon Sakhnini. Allowable Subject Matter Claims 10, 11, and 25 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. The following is a statement of reasons for the indication of allowable subject matter: the main reason for allowance is the inclusion of “wherein the combined reference signal configuration indicates an order of repetitions of the first repetition pattern and the second repetition pattern.” as the prior art of record in stand-alone form nor in combination read into the claims as supported by the specification. Claim 11 is allowed as it depend from an allowed claim. Claim 11 is allowed as it depends from an allowed claim. Conclusion The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. See PTO form PTO-892: US-20200229058-A1 to Park discloses combination of references signals for transmission and reception, US-20240244653-A1 to Takano discloses configuration of beam reports, and CN-111093272-A to Hao discloses transmission of reference Signals.
