Response to Amendment
The amendment filed 8/5/2026 is objected to under 35 U.S.C. 132(a) because it introduces new matter into the disclosure. 35 U.S.C. 132(a) states that no amendment shall introduce new matter into the disclosure of the invention. The added material which is not supported by the original disclosure is as follows:
Claim 1 introduces a double calculation frequency domain data of the same transmitted frame, which is not supported by applicant’s specification.
Claim 6 introduces a double calculation frequency domain data of the same frame, which is not supported by applicant’s specification.
Applicant is required to cancel the new matter in the reply to this Office Action.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Regarding claim 1 states “converting at least a subset of the received radar data associated with the transmitted frame from a time domain to a frequency domain to produce a set of frequency domain data for the transmitted frame and sets of frequency domain data for the transmitted frames;” This limitation appears to state that a set of frequency domain data is calculated twice, since a set of frequency domain data is calculated for each transmitted frame and then again sets of frequency domain data is calculated for the same transmitted frames. Based on the applicant’s specification the set of frequency domain data is only calculate once per transmitted frame. This contradiction renders the claim indefinite; therefore, the metes and bounds cannot be determined. The corresponding dependent claims of claim 1 inherit this contradiction and therefore are similarly rejected.
Claim 6, along with its dependent claims, is similarly rejected.
