Office Action

§102
DETAILED ACTION The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. Continued Examination Under 37 CFR 1.114 A request for continued examination under 37 CFR 1.114, including the fee set forth in 37 CFR 1.17(e), was filed in this application after final rejection. Since this application is eligible for continued examination under 37 CFR 1.114, and the fee set forth in 37 CFR 1.17(e) has been timely paid, the finality of the previous Office action has been withdrawn pursuant to 37 CFR 1.114. Applicant's submission filed on 03/26/26 has been entered. Response to Amendment The rejection of Claims 1, 2, 4-6, 8, 10, 11, 13-15, and 17-20 under 35 U.S.C. 102(a)(1) as being anticipated by Yoon et al. (KR 10-2019-0078541) as set forth in the Final Rejection filed 01/14/26 is overcome by the Applicant’s amendments. Specification The disclosure is objected to because of the following informalities: The Specification filed 07/12/22 recites the following structures: PNG media_image1.png 196 504 media_image1.png Greyscale PNG media_image2.png 180 484 media_image2.png Greyscale on pages 62-63 which are all graphically unclear due to their low resolutions; they contain fuzzy lines which are not clearly drawn. They all need to be replaced by structures which are clearly legible, with all bonds and atoms that are clearly drawn (i.e., with solid lines). Appropriate correction is required. Claim Objections Claim 19 is objected to because of the following informalities: The claim recites the following structures: PNG media_image1.png 196 504 media_image1.png Greyscale PNG media_image2.png 180 484 media_image2.png Greyscale (pages 48-49) which are all graphically unclear due to their low resolutions; they contain fuzzy lines which are not clearly drawn. They all need to be replaced by structures which are clearly legible, with all bonds and atoms that are clearly drawn (i.e., with solid lines). Appropriate correction is required. Allowable Subject Matter Claims 1-18 and 20 are allowed. Furthermore, Claim 19 is currently objected due to minor informalities, but would be allowable if amended to overcome the objection as set forth above. The closest prior art is provided by Yoon et al. Yoon et al. (KR 10-2019-0078541), which discloses compounds of the following form: PNG media_image3.png 238 300 media_image3.png Greyscale ([0041]); an embodiment is disclosed: PNG media_image4.png 86 128 media_image4.png Greyscale (page 215). However, it is the position of the Office that neither Yoon et al. singly nor in further combination with any other prior art discloses any of the compounds as recited in the claims, particularly in regards to the nature of the RA-D substituent groups of Applicant’s Formula I or the presence of further coordination to a metal M. Response to Arguments 8. Applicant’s arguments on pages 50-52 with respect to the deficiencies of the previously cited prior art in view of the newly amended claims have been fully considered and are persuasive. Hence, the rejection has been withdrawn. Conclusion 9. Any inquiry concerning this communication or earlier communications from the examiner should be directed to JAY L YANG whose telephone number is (571)270-1137. The examiner can normally be reached Mon-Fri, 6am-3pm. Examiner interviews are available via telephone, in-person, and video conferencing using a USPTO supplied web-based collaboration tool.
