DETAILED ACTION
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
This action is response to communication: response to RCE filed on 06/30/2026
Claims 1-7 and 9-20 are currently pending. Claim 8 has been cancelled. Claims 14-20 have been withdrawn.
The IDS filed on 06/30/2026 has been accepted.
A request for continued examination under 37 CFR 1.114, including the fee set forth in 37 CFR 1.17(e), was filed in this application after allowance or after an Office action under Ex Parte Quayle, 25 USPQ 74, 453 O.G. 213 (Comm'r Pat. 1935). Since this application is eligible for continued examination under 37 CFR 1.114, and the fee set forth in 37 CFR 1.17(e) has been timely paid, prosecution in this application has been reopened pursuant to 37 CFR 1.114. Applicant's submission filed on 06/30/2026 has been entered.
Claim Objections
Claim 1 is objected to because of the following informalities:
Claim 1 – “identifying a privacy vault of the particular user the privacy vault having a user defined access permission set for at least one service provider;”
This citation should include a comma, such as “particular user, the privacy vault having”
Claim 1 – “the behavior-based service modeled based on”
This citation includes a grammatical error that needs to be fixed. For example, the claim can be amended to “the behavior-based service based on” or “the behavior-based service modeled on”.
Appropriate correction is required.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
Claim 7 is rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
As per claim 7, the claim recites a “behavior-based service.” However, the claim is dependent on claim 1, which already recites a behavior-based service. It is unclear whether the behavior-based service cited in claim 7 is a different based service compared to the one already cited in the claim 1.
Allowable Subject Matter
Claims 1-6 and 8-13 are allowed.
The following is an Examiner’s statement of Reasons for Allowance:
Applicant's arguments/amendments submitted on 02/09/2026 have been considered and are persuasive in light of the arguments and claim amendments. The record is clear; therefore, no reason for allowance is necessary.
According to MPEP 1302.14 (I): “In most cases, the Examiner’s actions and the applicant’s replies make evident the reasons for allowance, satisfying the “record as a whole” provisio of the rule. This is particularly true when applicant fully complies with 37 CFR 1.111 (b) and (c) and 37 CFR 1.133(b). Thus, when the Examiner's actions clearly point out the reasons for rejection and the applicant's reply explicitly presents reasons why claims are patentable over the reference, the reasons for allowance are in all probability evident from the record and no statement should be necessary."
Any comments considered necessary by applicant must be submitted no later than the payment of the issue fee and, to avoid processing delays, should preferably accompany the issue fee. Such submissions should be clearly labeled “Comments on Statement of Reasons for Allowance.”
