DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 102 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention. Claim(s) 1-8,10,12 is/are rejected under 35 U.S.C. 102(a)(2) as being anticipated by Tohyama et al. (US 6451740;09/17/2002). Tohyama et al. teach at abstract the uracil compound of formula I: “ PNG media_image1.png 432 478 media_image1.png Greyscale ” Tohyama et al. table 5 at column 94 teach uracil compound S-27 which reads on instant compound of formula I where X1 is Br: X3 is H: X4 is H and A is OCH2CO2CH2CH3 suggesting the instantly claimed uracil compound; Z is phenyl; X is oxygen; Z is phenyl; Q is oxygen. Tohyama et al. at claims 32-36 the combination of the uracil compound being combined with an inert carrier or a diluent to yield a herbicidal composition. Tohyama et al.at the claims teach a method of applying the herbicidal composition onto weeds(undesirable vegetation to control weed growth.
