Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention.
Claim(s) 1, 5-8, 12, and 13 is/are rejected under 35 U.S.C. 102(a)(2) as being anticipated by Lee US 20220132558.
Regarding claim 1, 8, Lee teaches method performed by a first terminal (fig. 7 box 102) in a wireless communication system, the method comprising:
identifying whether sidelink data to be transmitted is available in a logical channel;
in case that the sidelink data is available in the logical channel, identifying whether
hybrid automatic repeat request (HARQ) feedback for the logical channel is enabled;
selecting a resource pool, based on a result of the identification;
selecting a resource from the selected resource pool; and
performing sidelink data transmission to a second terminal using the selected resource (For example, based on that the HARQ feedback is enabled for the logical channel, a first wireless device may select the sidelink resource among a pool of resources configured with Physical Sidelink Feedback Channel (PSFCH) resources., [0251], [0498]).
Regarding claim 5, 12, the first terminal is configured as a sidelink resource allocation mode 2, and
wherein selecting the resource from the selected resource pool is based on a random selection or sensing ([0298]).
Regarding claims 6, 13, receiving, from a base station, first configuration information for the logical channel ([0055] As such, in some implementations, the RRC layer controls logical channels, transport channels, and physical channels in relation to the configuration, reconfiguration, and release of radio bearers)and
second configuration information for the resource pool ([0225] In the context of group-based SL communication, it supported for UE-A to inform its serving gNB about members UE-B, UE-C, and so on of a group, and for the gNB to provide individual resource pool configurations and/or individual resource configurations to each group member through UE-A).
Regarding claim 7, the first configuration information and the second configuration information are received through a radio resource control (RRC) message ([0055]] or system information (implied [0225]).
Allowable Subject Matter
Claims 2-4 and 9-11 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
