Office Action

§DP
Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Acknowledgments This office action is in response to the reply filed on 1/21/26. In the reply, the applicant amended claims 1, 3, 5, 20; canceled claims 2, 4. Claims 1, 3, 5-20 are pending with claims 6-12, 14-20 being previously withdrawn. Claim 1 is allowable. The restriction requirement, as set forth in the Office action mailed on 8/21/25, has been reconsidered in view of the allowability of claims to the elected invention pursuant to MPEP § 821.04(a). The restriction requirement is hereby withdrawn as to any claim that requires all the limitations of an allowable claim. Specifically, the restriction requirement of claims 6-12 is withdrawn because the claims require all the limitations of an allowable claim. Also, support in the specification for the combination of elements, see [0020,0022]. However, claims 4-20 remain withdrawn because they do not require all the limitations of an allowable claim. In view of the above noted withdrawal of the restriction requirement, applicant is advised that if any claim presented in a divisional application is anticipated by, or includes all the limitations of, a claim that is allowable in the present application, such claim may be subject to provisional statutory and/or nonstatutory double patenting rejections over the claims of the instant application. Once a restriction requirement is withdrawn, the provisions of 35 U.S.C. 121 are no longer applicable. See In re Ziegler, 443 F.2d 1211, 1215, 170 USPQ 129, 131-32 (CCPA 1971). See also MPEP § 804.01. Allowable Subject Matter Claims 1, 3, 5-13 are allowed. 14-20 remain withdrawn, see above. Response to Arguments Applicant’s arguments filed 1/21/26, with respect to Species A have been fully considered and are persuasive. The rejection has been withdrawn and claims 6-12 withdrawn. Conclusion THIS ACTION IS MADE FINAL. Applicant is reminded of the extension of time policy as set forth in 37 CFR 1.136(a). A shortened statutory period for reply to this final action is set to expire THREE MONTHS from the mailing date of this action. In the event a first reply is filed within TWO MONTHS of the mailing date of this final action and the advisory action is not mailed until after the end of the THREE-MONTH shortened statutory period, then the shortened statutory period will expire on the date the advisory action is mailed, and any nonprovisional extension fee (37 CFR 1.17(a)) pursuant to 37 CFR 1.136(a) will be calculated from the mailing date of the advisory action. In no event, however, will the statutory period for reply expire later than SIX MONTHS from the mailing date of this final action.
