Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Continued Examination Under 37 CFR 1.114
A request for continued examination under 37 CFR 1.114, including the fee set forth in 37 CFR 1.17(e), was filed in this application after final rejection. Since this application is eligible for continued examination under 37 CFR 1.114, and the fee set forth in 37 CFR 1.17(e) has been timely paid, the finality of the previous Office action has been withdrawn pursuant to 37 CFR 1.114. Applicant's submission filed on 9/22/26 has been entered.
Claim 30 has been added by Applicant.
Claims 16-18, 20-23, and 30 are pending.
Claims 16 and 20 have been amended by Applicant.
Claims 16-18, 20-23, and 30 are currently under consideration.

New Rejections Necessitated by Amendments
Claim Rejections - 35 USC § 112
Claims 16-18, 20-23, and 30 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Claims 16-18, 20-23, and 30 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, because 35 U.S.C. 112(b) and 35 U.S.C. 112 (pre-AIA ), second paragraph, require claims to particularly point-out and distinctly claim subject matter. The instant claims attempt to incorporate by reference to a specific table or figure; however, such incorporation is permitted only in exceptional circumstances where there is no practical way to define the invention in words and where it is more concise to incorporate by reference than duplicating a drawing or table into the claim. In the instant case, there is a practical way to define the invention in words. Incorporation by reference is a necessity doctrine, not for applicant’s convenience. See MPEP 2173.05(s).
Response to Arguments
In the Reply of 9/22/26, Applicant argues claim 16 is not improper because claim 16 refers to Table 2 to concisely identify genes of Table 2 used in the invention and does not incorporate Table 2 by reference in a manner contemplated by MPEP 2173.05(s).
The amendments to the claims and the arguments found in the Reply of 9/22/26 have been carefully considered, but are not deemed persuasive. In regards to the argument that claim 16 is not improper because claim 16 refers to Table 2 to concisely identify genes of Table 2 used in the invention and does not incorporate Table 2 by reference in a manner contemplated by MPEP 2173.05(s), the examiner maintains the instant claims attempt to incorporate by reference to a specific table or figure; however, such incorporation is permitted only in exceptional circumstances where there is no practical way to define the invention in words and where it is more concise to incorporate by reference than duplicating a drawing or table into the claim. In the instant case, even though it would be more concise to recite “at least 70 genes listed in Table 2” than actually listing the 70 genes of Table 2, there is a practical way to define the invention in words – by listing the 70 genes. Incorporation by reference is a necessity doctrine, not for applicant’s convenience. See MPEP 2173.05(s).
