DETAILED ACTION The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA. Claim Rejections - 35 USC § 112 The following is a quotation of the first paragraph of 35 U.S.C. 112(a): (a) IN GENERAL.—The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor or joint inventor of carrying out the invention. The following is a quotation of the first paragraph of pre-AIA 35 U.S.C. 112: The specification shall contain a written description of the invention, and of the manner and process of making and using it, in such full, clear, concise, and exact terms as to enable any person skilled in the art to which it pertains, or with which it is most nearly connected, to make and use the same, and shall set forth the best mode contemplated by the inventor of carrying out his invention. Claim s 1-16 are rejected under 35 U.S.C. 112(a) or 35 U.S.C. 112 (pre-AIA), first paragraph, as failing to comply with the written description requirement. Claim 1 while providing a suitable written description when one of Ring A or Ring B is a 5-memebered ring f ails to provide a suitable written description when both of Ring A and Ring B are 5-memenered ring s . The subject matter was not described in the specification in such a way as to reasonably convey to one skilled in the relevant art that the inventor or a joint inventor, or for applications subject to pre-AIA 35 U.S.C. 112, the inventor(s), at the time the application was filed, had possession of this aspect of the claimed invention. The office takes the position that f used ring systems, with a combination of two five -membered rings both fused to a 6-memebered ring would have several inherent steric issues due to the constraints based on strained angle bonds along with conformational flexibility. Th e main issues are related to torsional strain , and ring strain resulting in higher energy requirements ring(s) conformation. T he specification is limited to the examples with Ring A and Ring B as 5-membered ring and 6-membered . No examples of both Ring A and Ring B a s 5-membered rings or a written description with sufficient infor mation for one of ordinary skill in the art to practice this aspect of the invention is offered. T he art is indeterminate as the methodology required to carry such a ring formation s for Ring A and Ring B as 5-membered rings in a 6-membered ring fused environment coordinated to a metal is unclear. The specification fail s to provide a written description for Ring A and Ring B both as 5-membered rings to a person skilled in the art to which it pertains, or with which it is most nearly connected, to carry out the invention commensurate with in scope with the instant aspect of the claims.
