DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Information Disclosure Statement The information disclosure statement (IDS) submitted on 09/22/2022 is in compliance with the provisions of 37 CFR 1.97. Accordingly, the information disclosure statement is being considered by the examiner. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 2, 3, and 6 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Claim 2 recites “a single direction of rotation” in line 2. It is not clear if this is the same single direction of rotation recited in claim 1. It is assumed that these are the same, and thus claim 2 should be amended to recite “the single direction of rotation.” Claim 3 is rejected because it depends from indefinite claim 2. Claim 6 recites “the first coupling element” in lines 2 and 4. There is insufficient antecedent basis for this limitation in the claim. The first coupling element is introduced in claim 3, which is not in the dependency chain of claim 6. Amending claim 4 to depend from claim 3 would overcome this rejection. Allowable Subject Matter Claims 1-16 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action. Conclusion The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. The cited art generally discloses hand-driven rotating mixing devices having ratchet members allowing for rotation in a single direction or mixers allowing for rotation of mixing implements in both directions.
