Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claim 1-3,5,7-16 and 18-25 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Claims 1 and 14 define the ligand LB with the formula 3: PNG media_image1.png 163 130 media_image1.png Greyscale but the Y4 and Y5 variables are never defined, and are not defined in the specification. This leaves the scope of LB indefinite. The other rejected claims are dependent from claim 1 or 14 and do not remedy the deficiency. Claims 4, 6, and 17 further define the ligand LB. Allowable Subject Matter Claims 4, 6, 17 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. Claims 1-3,5,7-16 and 18-25 would also be allowable if amended to obviate the 112 rejection above. The following is a statement of reasons for the indication of allowable subject matter: the dopant of the claims is disclosed in Kwon et al (US 20220069237 A1) and is combined with a single host material that does not read on either host of the claims. The first host of the claims is used as a host transport material in some references in combination with iridium complexes such as Mochizuki et al (US 20200328355 A1), but this is combined with a triphenylene functional electron transport host that does not read on second host of the claims, and furthermore they are included in different layers of the OLED. While bicarbazole hosts like the second host of the claims are known, it would require excessive hindsight on the part of the office to replace the single host material of Kwon with a host from Mochizuki, and furthermore combining with a second host material. There would not be an obvious reason to combine both hosts, and there would not be a reasonable expectation of success replacing the single host of Kwon.
