DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claim Rejections - 35 USC § 101 35 U.S.C. 101 reads as follows: Whoever invents or discovers any new and useful process, machine, manufacture, or composition of matter, or any new and useful improvement thereof, may obtain a patent therefor, subject to the conditions and requirements of this title. Claims 1-3, 5-6 are rejected under 35 U.S.C. 101 because the claimed invention is directed to judicial exception(s) without significantly more. [STEP 1] The claim recites at least structure. Thus, the claim is to product, which is one of the statutory categories of invention (Step 1: YES). [STEP2A PRONG I] The claim(s) 1 recite(s): A system for providing education using modeling, the system comprising: a user terminal; and a modeling server connected with the user terminal such that communication is possible, and configured to construct models for various fields of study on the basis of predetermined data, wherein the modeling server is configured to: receive fundamental data from the user terminal; receive a command giving an instruction related to the received fundamental data from the user terminal; create model information corresponding to a field of study designated by the command using the received fundamental data; and transmit the created model information to the user terminal wherein the command includes: a first command designating a field of study to be modeled and a subject in the field of study; and a second command designating a processing type for the received fundamental data under the designated field of study and subject, wherein the modeling server, in order to create the model information, is configured to: determine a field of study to be modeled and a subject in the field of study on the basis of the first command; determine a processing type for the received fundamental data on the basis of the second command; select a library corresponding to the determined field of study and subject by searching a database in a database module of the modeling server on the basis of the field of study and the subject; and process the fundamental data to create the model information in accordance with the determined processing type using contents in the selected library, wherein the modeling server, in order to process the fundamental data, is configured to: analyze the fundamental data; construct a graph using the analyzed fundamental data; and calculate parameters based on the graph, wherein the modeling server is configured to make a report including information about the graph and the parameters and to transmit the constructed graph and the report to the user terminal as the model information, wherein the use terminal is configured to display the graph and the report received from the modeling server. The non-highlighted aforementioned limitation, as drafted, is a process that, under its broadest reasonable interpretation, covers performance of the limitation between people but for the recitation of generic computer components. That is, other than reciting “user terminal” and “modeling server” nothing in the claim element precludes the step from practically being performed between people. For example, but for the recited language, the step in the context of this claim encompasses a teacher providing prompts to a student, observing students’ response and adjusting its instruction/lecture level accordingly. If a claim limitation, under its broadest reasonable interpretation, covers managing interactions between people, then it falls within the “Organization of Human Activity” grouping of abstract ideas. Additionally, if the claim limitation, under its broadest reasonable interpretation, covers the act of that can be performed in the human mind (observation, evaluation, judgment, and providing opinion), then it falls within the “Mental Process” grouping of abstract idea. Accordingly, the claim recites a judicial exception, and the analysis must therefore proceed to Step 2A Prong Two. [STEP2A PRONG II] This judicial exception is not integrated into a practical application. In particular, the claim only recites the additional element(s) – “user terminal” and “modeling server”. The “user terminal” and “modeling server” in the aforementioned steps are recited at a high-level of generality (i.e., as a generic processor performing a generic computer function) such that it amounts no more than mere instructions to apply the exception using a generic computer component. Accordingly, the additional element(s) do(es) not integrate the abstract idea into a practical application because it does not impose any meaningful limits on practicing the abstract idea and the claim is therefore directed to the judicial exception. (Step 2A: YES). [STEP2B] The claim does not include additional elements that are sufficient to amount to significantly more than the judicial exception. As discussed above with respect to integration of the abstract idea into a practical application, the additional element of using a processor to perform the aforementioned steps amounts to no more than mere instructions to apply the exception using a generic computer component, which cannot provide an inventive concept (for example, see paragraph 31). As noted previously, the claim as a whole merely describes how to generally “apply” the aforementioned concept in a computer environment. Thus, even when viewed as a whole, nothing in the claim adds significantly more (i.e., an inventive concept) to the abstract idea. The claim is not patent eligible. (Step 2B: NO). Claims 2-3 and 5-6 are dependent on supra claim(s) and includes all the limitations of the claim(s). Therefore, the dependent claim(s) recite(s) the same abstract idea. The claim recites no additional limitations. Accordingly, the additional element(s) do(es) not integrate the abstract idea into a practical application because it does not impose any meaningful limits on practicing the abstract idea and the claim is therefore directed to the judicial exception. Looking at the limitations as an ordered combination adds nothing that is not already present when looking at the elements taken individually. There is no indication that the combination of elements improves the functioning of a computer or improves any other technology. Thus, even when viewed as a whole, nothing in the claim adds significantly more (i.e., an inventive concept) to the abstract idea. Response to Arguments The Applicant argued that the amended limitation integrates the claims into a practical application and amount to significantly more than the abstract idea because: “The amended claims would analyze the fundamental data, and calculates parameters based on the graph. Then, the modeling server makes a report including information about the graph and the parameters and transmits the graph and the report to the user terminal. Finally, the user terminal provides an education service to a user by displaying the graph and the report, as shown in FIG. 6 and 7.” The examiner respectfully disagrees. As the current case laws, as seen in MPEP 2106.04(d), do not support the Applicant’s assertion. It is unclear how the creation of an education service to the user, display the associated graph or report would be consisted be direct to either: An improvement in the functioning of a computer, or an improvement to other technology or technical field, as discussed in MPEP §§ 2106.04(d)(1) and 2106.05(a); Applying or using a judicial exception to effect a particular treatment or prophylaxis for a disease or medical condition, as discussed in MPEP § 2106.04(d)(2); Implementing a judicial exception with, or using a judicial exception in conjunction with, a particular machine or manufacture that is integral to the claim, as discussed in MPEP § 2106.05(b) Effecting a transformation or reduction of a particular article to a different state or thing, as discussed in MPEP § 2106.05(c); and Applying or using the judicial exception in some other meaningful way beyond generally linking the use of the judicial exception to a particular technological environment, such that the claim as a whole is more than a drafting effort designed to monopolize the exception, as discussed in MPEP § 2106.05(e). At best, the creation of an education service to a user by displaying the graph and the report can be interpreted as the use of a computer as tool to automate an abstract idea or linking the use of a judicial exception to a particular technological environment or field of use. As such, the rejection on claims 1-3, 5-6 are still warranted and will be maintained. Conclusion Applicant's amendment necessitated the new ground(s) of rejection presented in this Office action. Accordingly, THIS ACTION IS MADE FINAL. See MPEP § 706.07(a). Applicant is reminded of the extension of time policy as set forth in 37 CFR 1.136(a). A shortened statutory period for reply to this final action is set to expire THREE MONTHS from the mailing date of this action.
