DETAILED ACTION
Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention.
Claims 1, 2, 4-17, 19 are rejected under 35 U.S.C. 102(a)(2) as being anticipated by MIN et al PG PUB 2020/0022157.
Re Claims 1 and 16, MIN et al teaches a Trigger-based MU UL transmission scheme configured to support OFDMA according to IEEE802.11ax standard wherein a AP (comprising a processor coupled to a transceiver) of WLAN supports MU-MAC [0085]; the AP receiving from UL control frames from a plurality of STAs wherein the UL control frames include BSR (queue information) [0091] for determining Tx configuration parameters such as the MCS for sending a trigger frame scheduling for the plurality of STAs.
Re Claims 2, 17, MIN et al teaches the UL control frame includes the Buffer Status Report (queue information) [0091].
Re Claims 4, 19, MIN et al teaches the trigger frame supporting UL transmission.
Re Claims 5, 20, MIN et al teaches the trigger frame includes RU configuration information, time slots and RUs [0088].
Re Claims 6, 7, 21, 22, MIN et al teaches optimizing for throughput and performance [0091].
Re Claims 8, 23, MIN et al teaches the AP determining the Tx parameters for the STAs (first and second) such as the MCS selection (first and second) based on the PER performance [0096].
Claim Rejections - 35 USC § 103
The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action:
A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made.
Claims 3 and 18 are rejected under 35 U.S.C. 103 as being unpatentable over MIN et al PG PUB 2020/0022157 in view of Cheng et al PG PUB 2019/0230674.
Re Claims 3 and 18, MIN et al fails to explicitly teach “the scheduling information is sent in an HE-SIG-B field”. However, Cheng et al teaches IEEE802.11ax supports HE-SIG-B [0036]. One skilled in the art would have been motivated to have modified the trigger frame to support the HE-SIG-B to be consistent with the IEEE802.11ax. Therefore, it would have been obvious to one skilled to have combined the teachings.
