Office Action

§102
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claims 9-23 are canceled. Therefore, claims 1-8 are currently pending in this Application. Priority CONTINUING DATA This application is a 371 of PCT/JP2021/027915 07/28/2021 FOREIGN APPLICATIONS JAPAN 2020-128216 07/29/2020 Information Disclosure Statement Applicant’s Information Disclosure Statements, filed on 02/25/2023; 10/14/2024; 06/02/2025; 11/12/2025; and 01/29/2026 have been considered. Please refer to Applicant’s copies of the 1449 submitted herewith. Application Title The title of the invention, i.e. “Method of Manufacturing Compound” is not descriptive. A new title is required that is clearly indicative of the invention to which the claims are directed. The following title is suggested: " Method of Manufacturing Pyrazolone Compounds ” Response to Restriction Applicants’ election, without traverse, the invention of Group I, claims 1-8, drawn to a method of preparing products of Formula 3, PNG media_image1.png 133 175 media_image1.png Greyscale , in response filed on April 16, 2026 is acknowledged. Therefore, the restriction requirement is considered proper and is maintained. Applicant is reminded that upon the cancellation of claims to a non-elected invention, the inventorship must be amended in compliance with 37 CFR 1.48(b) if one or more of the currently named inventors is no longer an inventor of at least one claim remaining in the application. Any amendment of inventorship must be accompanied by a petition under 37 CFR 1.48(b) and by the fee required under 37 CFR 1.17(i). Claim Rejections - 35 USC § 102 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale or otherwise available to the public before the effective filing date of the claimed invention. (a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention. Claims 1-8 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Dirat et al. Tetrahedron Letters 47 (2006) 1729–1731. The instant elected invention is drawn to a process of preparing pyrazolone products of Formula 3, PNG media_image1.png 133 175 media_image1.png Greyscale wherein the variables are as defined in claim 1. The process comprises reacting a hydrazine product of Formula 1, PNG media_image2.png 84 156 media_image2.png Greyscale with acetoacetate product of Formula 2, PNG media_image3.png 78 192 media_image3.png Greyscale . Claims 2-8 further define the variables R1, R2 and R3. Dirat et al teach a process of preparing pyrozolone products by reaction a hydrazine product and an acetoacetate product ( See Scheme 2) PNG media_image4.png 94 246 media_image4.png Greyscale Therefore, claims 1-8 are anticipated by Dirat et al Telephone Inquiry Any inquiry concerning this communication or earlier communications from the examiner should be directed to KAMAL A SAEED whose telephone number is (571) 272-0705.
