§102 §103
Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA. Claim Rejections - 35 USC § 102 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale , or otherwise available to the public before the effective filing date of the claimed invention. Claims 1, 2, 4-6, 10, 11, 13, 15-17 and 20-25 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Jeong et al. (hereinafter “Jeong”) (KR 10-2018-0034943 A , cited by Applicant; see English machine translation ). Regarding claim s 1 , 4-6 , 10, 11, 13 , 15 and 22-2 5 , Jeong teaches a n all-solid-state three-dimensional battery 100 (all-solid-state battery) including a positive current collector 10, a positive structure 12 (electrode layer including a current collector and an electrode active material layer) , an electrolyte structure 14 (solid electrolyte layer) , a negative structure 16 (neighboring electrode active material layer) and a negative current collector 18 (see paragraphs 20 and 22; FIG. 1) . The positive structure 12 includes a horizontal part 12A (electrode active material disposed on at least one surface of the current collector) and a vertical part 12B (extension portion) , wherein the horizontal part 12A is parallel to the positive current collector 10. Multiple vertical sections 12B are provided so as to be spaced apart from each other and parallel to each other (see paragraph 22). The electrolyte structure 14 and the negative structure 16 are overlayed on top of the positive structure 12 so as to match the shape thereof. This results in vertical and horizontal portions of both the electrolyte structure 14 and the negative structure 16, wherein vertical parts 12B of the positive structure 12 are adjacent to the vertical portions of the negative structure 16 with vertical portions of the electrolyte structure (bent portion extends in the stacking direction) interposed therebetween (portion disposed adjacent to a neighboring electrode material layer in the plane direction). Regarding claim 2 , FIG. 2 of Jeong clearly illustrates vertical parts 12B of the positive structure 12 which are located at the ends of the horizontal part 12A thereof. Regarding claim 16 , Jeong permits a width W1 of the vertical parts 12B of the positive structure 12 to the same as or greater than a gap D1 between adjacent vertical parts 12B. Because the vertical portions of the electrolyte structure 14 and the negative structure 16 are received within these gaps, this would arrangement would require a width W1 of the vertical parts 12B to be greater than a width of the vertical portions of the negative structure 16. Regarding claim 17 , it is understood from FIG. 1 of Jeong that a height H1 of the vertical parts 12B of the positive structure 12 is greater than a thickness of the horizontal portions of the negative structure 16. Regarding claim s 20 and 21 , Jeong teaches a process in which horizontal parts 50 and vertical parts 40 of a positive electrode structure are formed on a positive current collector 60 (forming a first active material layer on a first current collector) (see paragraph 50; FIGS. 8 and 9). Next , a solid electrolyte layer 104 covering the vertical parts 40 and the horizontal parts 50 of the positive electrode structure is formed on the positive current collector 60 (interposing a solid electrolyte layer between a first active material layer and a second active material layer) (see paragraph 53; FIG. 10) . Next, a negative electrode structure 110 is provided to cove r the electrolyte layer 104 (see paragraph 54; FIG. 11). Next, a negative current collector 120 is formed on the negative electrode structure 110 (forming a second active material layer on a second current collector) (see paragraph 55; FIG. 12) . Claim Rejections - 35 USC § 103 The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action: A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made. The factual inquiries for establishing a background for determining obviousness under 35 U.S.C. 103 are summarized as follows: 1. Determining the scope and contents of the prior art. 2. Ascertaining the differences between the prior art and the claims at issue. 3. Resolving the level of ordinary skill in the pertinent art. 4. Considering objective evidence present in the application indicating obviousness or nonobviousness. Claim 7 is rejected under 35 U.S.C. 103 as being unpatentable over Jeong as applied to claims 1, 2, 4-6, 10, 11, 13, 15-17 and 20-25 above. Regarding claim 7 , although not explicitly taught by Jeong, it is well known in the art to provide an active material layer on both surfaces of a current collector (other electrode active material layer) in order to maximize energy density within the cell by minimizing current collector volume. Allowable Subject Matter Claims 3, 8, 9, 12, 14, 18, 19 and 26 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
