Claim Rejections - 35 USC § 103
The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action:
A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made.
Claim(s) 1-15 is/are rejected under 35 U.S.C. 103 as being unpatentable over EP 2572574 (2013).
EP 2572574 teaches a steel wire core with a zinc, zinc aluminium alloy, zinc aluminium magnesium alloy and copper alloy (see claims). Meeting claims 4-5 and 7.
Regarding claims 6,
The wire can also be coated with a high density polyethylene coating (See claims).
Regarding claim 2, the art appears to teach 1 coating of polymer (See claims).
Regarding claims 8-9, and 10, and 14-15 the polymer coating can be a copolymer, including ethylene and other polymer or acid groups (See [0022-0023]).
Regarding claim 12, the wire can be chain link fence (See claims).
Regarding claim 13, the art teaches a gabion or wire container (See figures), usable as a gabion, designed for use in water and rendering it obvious to provide.
It would have been obvious to one of ordinary skill in the art at the time of filing to provide the claimed polymer coating with the claimed monomers or mixtures to provide specific properties to the coating and wire, as discussed in EP above [0022], such that the corrosive resistance, biological properties, weight, abrasion resistance, thickness concerns or other desired properties discussed throughout the application [0022, 0030, and elsewhere]).
Regarding claims to transition coating the art (above EP reference) teaches multilayered coatings including the metal material(s) claimed (See claims). It would have been obvious to one of ordinary skill in the art at the time of filing to provide the claimed coatings to provide specific properties to the coating and wire, as discussed in EP above [0022], such that the corrosive resistance, biological properties, weight, abrasion resistance, thickness concerns or other desired properties discussed throughout the application [0022, 0030, claims and elsewhere]).
