Office Action

§102
Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Claims 1-14 are presented for examination. Applicants’ information disclosure statements filed April 23, 2023 have been received and entered. Applicants’ election filed March 2, 2026 in response to the restriction requirement of January 2, 2026 has been received and entered. The applicants elected the invention described in claims 1-11 (Group I) without traverse. Claims 12-14 are withdrawn from consideration as being drawn to the non-elected invention (37 CFR 1.142(b)). Priority Applicant’s claim for the benefit of a prior-filed application under 35 U.S.C. 119(e) or under 35 U.S.C. 120, 121, 365(c), or 386(c) is acknowledged. Receipt is acknowledged of certified copies of papers required by 37 CFR 1.55. Claim Objections Claims 2-11 are objected to as being dependent upon a rejected base claim. Claim Rejections - 35 USC § 102 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention. Claim(s) 1 is rejected under 35 U.S.C. 102(a)(2) as being anticipated by WO 2018/115380 A1, hereby known as Gmachl et al. Gmachl et al. teach benzylamino substituted quinazolines and derivatives derived from the same as applicants’ core structure for substituted benzo or pyridopyrimidine amines (see the abstract). Note page 246, claim 12, the R7 is selected from the group consisting of C1-4 alkyl and C1-4 haloalkyl, the same as applicants’ R5 is selected from the group consisting of substituted or unsubstituted group: C1-C6 alkyl, or halogenated C1-C18 alkyl. The R3 substituent is selected form the group consisting of C1-4 alkyl as the applicants’ X is CR6, wherein R6 is hydrogen, C1-C6 alkyl. The R2 is selected from the group consisting of hydrogen and halogen as the applicants’ R1 is hydrogen, halogen. The R1 is -O-RA wherein the RA is C3-10 cycloalkyl, and the applicants’ Y is O and Z is a bond and substituted or unsubstituted C1-C18 alkylene, and W isC3-C20 cycloalkylene, 4- to 20-membered heterocyclylene. The R4 is selected from C1-4 alkyl, C1-4 haloalkyl, R5 is selected from hydrogen and -NH2, and R6 is selected from hydrogen, C1-4 alkyl and halogen as the applicants’ R3 is selected from C3-C18 cycloalkyl, C6-C14 aryl, and the R4 is C1-C6 alkyl, CONH2. Clearly, the cited reference anticipates applicants’ instant compounds; therefore, applicants’ instant compounds are unpatentable. Claim 1 is not allowed.
