Claim Rejections - 35 USC § 102
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 1 is/are rejected under 35 U.S.C. 102a1 as being anticipated by Perini (US Patent No. 10,315,873).
Regarding claim 1, the Perini reference discloses a device for handling cardboard reels, characterized in that it includes a main body (Fig. 2) with a rod (e.g. 50) on which are arranged:
- a first unit (Fig. 2) with two axially opposed plates (60,61), provided with respective radially expandable parts (6), and spaced apart by a predetermined value along an axial direction (Fig. 2) of said rod so to form a pressurizable space (space between 60,61) between said plates, said space being delimited above and below by opposite surfaces (opposite surfaces of 60,61) of the same plates (Fig. 2);
- means for controlling the radial expansion of said parts (Col. 3, Lines 24-34);
- pressurization means for pressurizing said space (Col. 3, Lines 24-34).
Allowable Subject Matter
Claims 9-12 are allowed.
Claims 2-8 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
