Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Information Disclosure Statement The information disclosure statement filed on 11/15/22 fails to comply with 37 CFR 1.98(a)(2), which requires a legible copy of each cited foreign patent document; each non-patent literature publication or that portion which caused it to be listed; and all other information or that portion which caused it to be listed. It has been placed in the application file, but the information referred to therein has not been considered. Claim Objections Claim 1 is objected to because of the following informalities: In claim 1, line 8, “a first blade portion proximal end” should be –the first blade portion proximal end--. Appropriate correction is required. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claims 1-14 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Claim 1 recites the limitation "the first blade portion proximal end" in lines 6-7. There is insufficient antecedent basis for this limitation in the claim. Claim 14 recites the limitation "the sharp end" in line 1. There is insufficient antecedent basis for this limitation in the claim. In claim 14, the phrase, “the sharp end is twisted at a second predefined angle,” is indefinite and vague. What constitutes “a second predefined angle?” Allowable Subject Matter Claims 15-20 are allowed. Claims 1-14 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action. The following is a statement of reasons for the indication of allowable subject matter: The claims 15-20 are patentable over the prior art of record because the teachings of the references taken as a whole do not show or render obvious the combination set forth in claims 15 and 20, including every structural element recited in the claim, especially an elongated blade comprising a first blade portion and a second blade portion, each blade having a proximal end and a distal end, and connected to each other with a Z-shaped connector with an elongated tube with a tube distal end and a tube proximal end and a figure support surface located in a certain way as claimed by the applicant. None of the references of the prior art teach or suggest the elements of the device as advanced above and such do not provide the necessary motivation, absent applicant's specification, for modifying the device in the manner required by the claims.
