Office Action

§102
Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Status of Claims Claims 1-15 are pending. Claims 1-14 are allowed. Claim 15 has been amended. Status of Amendments The amendment filed March 16th, 2026 has been fully considered, but does not place the application in condition for allowance. Status of Objections and Rejections Pending since the January 2nd, 2026 The 102 rejection over Mascianica (US 2017/0077566 A1) is withdrawn in view of the Applicant's amendment. Continued Examination Under 37 CFR 1.114 A request for continued examination under 37 CFR 1.114, including the fee set forth in 37 CFR 1.17(e), was filed in this application after final rejection. Since this application is eligible for continued examination under 37 CFR 1.114, and the fee set forth in 37 CFR 1.17(e) has been timely paid, the finality of the previous Office action has been withdrawn pursuant to 37 CFR 1.114. Applicant's submission filed on March 16th, 2026 has been entered. Claim Rejections - 35 USC § 102 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. Claim 15 is rejected under 35 U.S.C. 102(a)(1) as being anticipated by Hurko (US 3783854 A). Hurko discloses an integrated venting and cooling device (title; a heat exchanger is inherently a venting and cooling device). Hurko continues to disclose a venting channel (95) that is delimited by a first side (the bottom wall; 91) and a second side (top wall; 99) in a first direction (vertical direction as depicted by the arrow). The venting opening (93) on the first side that allows venting gases to enter then channel as well as the cooling channel (83) for cooling the venting channel are also depicted below in the annotated figure. The cooling channel is underneath the venting channel in the first direction. PNG media_image1.png 1034 588 media_image1.png Greyscale Response to Arguments Applicant’s arguments with respect to claim 15 have been considered but are moot because the new ground of rejection does not rely on any reference applied in the prior rejection of record for any teaching or matter specifically challenged in the argument. Conclusion Any inquiry concerning this communication or earlier communications from the examiner should be directed to RYAN K BLACKWELL-RUDASILL whose telephone number is (571)270-0563.
