The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 21-40 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Won (KR101731305B1).
Re claims 21, 29 and 39: Won discloses a folding type net for sports comprising: a first, second, third and fourth net modules 120 (as shown in fig. 9) including a first/second/third/fourth spool 123 (as shown in fig. 2 and A-A’); a first/second/third/fourth net 123 (see fig. 2 and A-A’) and a first/second/third/fourth connector 122 (see fig. 2 and A-A’); and a base connector (110, 111) (see fig. C-C’ and fig. 9) having an outer surface and an inner surface defining a hollow interior and a plurality of openings 112 (first/second/third/fourth array of openings) (see fig. C-C’) extending from the outer surface to the inner surface to be in communication with the hollow interior (see para. 0013 and 0016).
Re claims 22-24, 30-34, 27-28 and 37-38: Won teaches wherein the base connector (110, 111) is configured to detachably engage with the first/second/third/fourth connectors via cooperating hooks 122 (see fig. 2) configured to be received with respective ones of the plurality of independent openings 112 (see fig. C-C’).
Re claims 25-26, 35-36 and 40: Won further teaches wherein the base connector (110, 111) further comprising a shaft (133, 134) (see fig. 10) connected to the base connector wherein the shaft is configured to be detachably engageable to the base connector (see para. 0051).
Conclusion
The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. Reiner (US 2019/0063018) discloses a retractable barrier assembly.
