Office Action

§102
Detailed Action The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . This is a final action for application number 18/121,415 in response to an amendment filed on 02/20/2026; the original application filed on 03/14/2023. Claims 1-20 are currently pending and have been considered below. Claims 1, 8 and 15 are independent claims. Claims 1 and 8-15 and have been amended. Response to Arguments Applicants’ arguments with respect to claims 1-20 have been considered but are moot in view of the new ground(s) of rejection. Continued Examination Under 37 CFR 1.114 A request for continued examination under 37 CFR 1.114, including the fee set forth in 37 CFR 1.17(e), was filed in this application after final rejection. Since this application is eligible for continued examination under 37 CFR 1.114, and the fee set forth in 37 CFR 1.17(e) has been timely paid, the finality of the previous Office action has been withdrawn pursuant to 37 CFR 1.114. Applicant’s submission filed on 02/20/2026 has been entered. Claim Rejections - 35 USC § 102 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention. Claims 1-20 are rejected under 35 U.S.C. 102(a)(2) as being anticipated by Mansour et al. The applied reference has a common applicant with the instant application. Based upon the earlier effectively filed date of the reference, it constitutes prior art under 35 U.S.C. 102(a)(2). This rejection under 35 U.S.C. 102(a)(2) might be overcome by: (1) a showing under 37 CFR 1.130(a) that the subject matter disclosed in the reference was obtained directly or indirectly from the inventor or a joint inventor of this application and is thus not prior art in accordance with 35 U.S.C. 102(b)(2)(A); (2) a showing under 37 CFR 1.130(b) of a prior public disclosure under 35 U.S.C. 102(b)(2)(B) if the same invention is not being claimed; or (3) a statement pursuant to 35 U.S.C. 102(b)(2)(C) establishing that, not later than the effective filing date of the claimed invention, the subject matter disclosed in the reference and the claimed invention were either owned by the same person or subject to an obligation of assignment to the same person or subject to a joint research agreement. Regarding claims 1, 8 and 15, a method for providing dynamic resource sharing based on location and time of day, the method comprising: receiving historical data corresponding to a node providing service to one or more user UEs, [at block 602, the first sector data collector 216 collects historical data for a first sector comprising previous locations of one or more additional WCDs located within the first sector, (Mansour et al., Col. 20, lines 6-12)], wherein the node communicates with the one or more UEs using dynamic beamforming, [access point 214 may selectively communicate with the user devices using dynamic beamforming, (Mansour et al., Col. 9, lines 43-46)], wherein the historical data comprises geographic locations of the one or more UEs and time of day, [The historical data collected by the WCD data collector 218 may also include data about the time of day, (Mansour et al., Col. 10, lines 52-55)], and based on the geographics locations and the time of day, dynamically adjusting, using dynamic beamforming, a downlink/uplink ratio for one or more beams, [the uplink power transmission is proactively modified based on one or more types of historical data collected and analyzed such as noise interference, time of day, and location of the WCD, resulting in the access point proactively instructing the WCD to adjust the maximum uplink power directly to the specific level determined, (Mansour et al., Col. 1, lines 46-54)]. Regarding claims 2, 9 and 16, the method wherein the historical data further comprises uplink usage and downlink usage, [the method involves collecting uplink and downlink traffic in the cell, computing the traffic ratio of uplink and downlink in each period of time in a predetermined cycle based on the uplink and downlink traffic, determining the matched time slot allocation ratio of uplink and downlink based on the traffic ratio of uplink and downlink, recording the period of time and the corresponding time slot allocation ratio of uplink and downlink, (Zhang et al., Abstract)]. Regarding claims 3, 10 and 17, the method wherein the node provides time division duplex (TDD) communication links to the one or more UEs, [Network parameters may indicate a realized uplink and/or downlink transmission data rate, observed signal-to-interference-plus-noise ratio (SINR) and/or signal strength at the user device, path loss, or throughput of the connection, (Mansour et al., Col. 10, lines 19-25)]. Regarding claims 4, 11 and 18, the method further comprising identifying a trend in the historical data, [Network parameters may indicate a realized uplink and/or downlink transmission data rate, observed signal-to-interference-plus-noise ratio (SINR) and/or signal strength at the user device, path loss, or throughput of the connection, (Mansour et al., Col. 10, lines 19-25)]. Regarding claims 5, 12 and 19, the method wherein the trend corresponds to the time of day, [The historical data collected by the WCD data collector 218 may also include data about the time of day, (Mansour et al., Col. 10, lines 52-55)] Regarding claims 6, 13 and 19, the method wherein the trend corresponds to a particular area serviced by the node, [The first sector data collector 216 of the dynamic power allocation engine 212 is generally responsible for collecting historical data from one or more WCDs 202, 204, and 206 located within a sector and within coverage area of access point 214, (Mansour et al., Col. 10, lines 1-10)]. Regarding claims 7, 14 and 20, the method wherein the dynamically adjusting corresponds to the trend, [the uplink power transmission is proactively modified based on one or more types of historical data collected and analyzed such as noise interference, time of day, and location of the WCD, resulting in the access point proactively instructing the WCD to adjust the maximum uplink power directly to the specific level determined, (Mansour et al., Col. 1, lines 46-54)]. Conclusion Any inquiry concerning this communication or earlier communications from the examiner should be directed to Shukri Taha whose telephone number is 571-270-1921. The examiner can normally be reached on 8:30am-5pm Mon-Fri. If attempts to reach the examiner by telephone are unsuccessful, the examiner’s supervisor, Joseph Avellino can be reached on 571-272-3905.
