Office Action

§112
DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Drawings Figure 1 should be designated by a legend such as --Prior Art-- because only that which is old is illustrated. See MPEP § 608.02(g). Corrected drawings in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. The replacement sheet(s) should be labeled “Replacement Sheet” in the page header (as per 37 CFR 1.84(c)) so as not to obstruct any portion of the drawing figures. If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance. The drawings are objected to because the word “Memorx” labeled in the block element (204b) of FIG. 2 should be “Memory”, and the block element (208) should be labeled “PA”. Corrected drawing sheets in compliance with 37 CFR 1.121(d) are required in reply to the Office action to avoid abandonment of the application. Any amended replacement drawing sheet should include all of the figures appearing on the immediate prior version of the sheet, even if only one figure is being amended. The figure or figure number of an amended drawing should not be labeled as “amended.” If a drawing figure is to be canceled, the appropriate figure must be removed from the replacement sheet, and where necessary, the remaining figures must be renumbered and appropriate changes made to the brief description of the several views of the drawings for consistency. Additional replacement sheets may be necessary to show the renumbering of the remaining figures. Each drawing sheet submitted after the filing date of an application must be labeled in the top margin as either “Replacement Sheet” or “New Sheet” pursuant to 37 CFR 1.121(d). If the changes are not accepted by the examiner, the applicant will be notified and informed of any required corrective action in the next Office action. The objection to the drawings will not be held in abeyance. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Claim 5 is rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Claim 5 recites the limitation “the pre-stored cancellation pulse” in line 1. There is insufficient antecedent basis for this limitation in the claim. Allowable Subject Matter Claims 1-4 and 6-18 are allowed. Claim 5 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action. Conclusion The prior art made of record and not relied upon is considered pertinent to applicant's disclosure. Ng et al. relates to a functional block diagram of Multi-Beam crest factor reduction (CFR) peak cancellation (CFR-PC) circuit in Figure 8 comprising at least: a peak detector (8-5); a peak cancellation pulse (PCP 8-6); a PCP length delay (8-2a); and a subtracter (8-8a). Suzuki et al. relates to a signal power dynamic range compressing circuit in Figure 5 comprising at least: a directional coupler (2); a delay line (3); a signal generator (4) including a level discriminator (41), a peak power detector (42), a low-frequency oscillator (44), a frequency converter (45), a variable phase shifter (46), and a variable amplifier (47); a signal adjustment part (11) including a level discriminator (15), a peak power detector (16), and a control circuit (17); and a power combining circuit (6). Megretski et al. relates to a crest factor reduction (CFR) circuit in Figure 8 comprising: a peak detector (820); an FIR or LPF (830); and a subtracter (840). KWON et al. relates to a CFR module (100) in Figure 1 comprising: a peak detection circuit (110); a cancellation pulse generation circuit (120); a delay circuit (130); and a subtracter (140).
