DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA. Claim Objections Claim 15 is objected to because of the following informalities: Claim 15, Line 1 recite “for conveyance for conveying”. This appears to be duplicate language which may be unnecessary. Appropriate correction is required. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b ) CONCLUSION.— The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the appl icant regards as his invention. Claims 1 -20 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. Claim 1, Lines 2-3 recite “the gripper whose one end is connected to a first fixture and the other end connected to a second fixture”. The examiner first noting, this is indefinite and unclear as to whether the applicant is actually claiming the “a first fixture” and the “a second fixture” as part of the “gripper” itself? Additionally, claim 1 goes on to recite “a plurality of twisted loops.” A review of the application appears to show that the “plurality of twisted loops” actually have their ends attached to the first and second fixtures, and thus it is indefinite and unclear as to how the “plurality of twisted loops” relate to the gripper having one end and an opposed end attached to the first and second fixtures? I.e., are the recited one end and the opposed end of the gripper actually part of the “plurality of twisted loops”? Claim 1 recites the limitation "the other end" in Line 2. There is insufficient antecedent basis for this limitation in the claim. To overcome this rejection, replace the phrase "the other end" with " the an other end". Claim 5 recites “a large gripper” and “a small gripper”. However, it is indefinite and unclear as to how each of the “a large gripper” and “a small gripper” relate to the “gripper” as recited in claims 1 and 2? Additionally, claim 5 recites “a longer strap” and “a shorter strap”. However, it is indefinite and unclear as to how each of the “a longer strap” and “a shorter strap” relate to the “a plurality of twisted loops” as recited in claim 1? Claim 9 recites “wherein the loop is a strap.” However, it is indefinite and unclear as to whether the “loop” as recited in claim 9 is meant to be one of the loops of claim 1 or all of the loops of claim 1? Claim 11 recites “wherein the loop is an arc-shaped strap.” However, it is indefinite and unclear as to whether the “loop” as recited in claim 11 is meant to be one of the loops of claim 1 or all of the loops of claim 1? Claim 12 recites “wherein the loop includes a reinforcing member.” However, it is indefinite and unclear as to whether the “loop” as recited in claim 12 is meant to be one of the loops of claim 1 or all of the loops of claim 1? Claim 1 3 lacks any type of transition phrase in the form of “comprising”, “consisting of” or “consisting essentially of”. As such, it is ind efinite and unclear as to what constitute the meets and bounds of the claims as no transition phrase has been presented. For purposes of examination , the examiner has assumed that claim 1 intends to use the transition phrase of “comprising”. Addition of an appropriate transition phrase is required. Claim 13 , Lines 2-3 recite “wherein the gripper has one end connected to a first fixture and the other end connected to a second fixture”. The examiner first noting, this is indefinite and unclear as to whether the applicant is actually claiming the “a first fixture” and the “a second fixture” as part of the “gripper” itself? The examiner first noting, this is indefinite and unclear as to whether the applicant is actually claiming the “a first fixture” and the “a second fixture” as part of the “gripper” itself? Additionally, claim 15 goes on to recite “a plurality of twisted loops.” A review of the application appears to show that the “plurality of twisted loops” actually have their ends attached to the first and second fixtures, and thus it is indefinite and unclear as to how the “plurality of twisted loops” relate to the gripper having one end and the other end attached to the first and second fixtures? I.e., are the recited one end and the other end of the gripper actually part of the “plurality of twisted loops”? Claim 15 recites the limitation "the other end" in Line 5. There is insufficient antecedent basis for this limitation in the claim. To overcome this rejection, replace the phrase "the other end" with " the an other end". Claim 16 recites “one end of each of the plurality of loops…” and “the other end of each of the plurality of loops…” However, it is indefinite and unclear as to how the “one end” and the “the other end” as recited in claim 16 relate to the previously recited “one end” and the “the other end” as recited in claim 15 as discussed above? Claim 19 recites “the second fixture is a cylindrical cylinder.” However, claim 16, which claim 19 depends upon, has already set forth that “the second fixture is a plate-shaped second plate.” Therefore, it is indefinite and unclear as to how claim 19 could set forth the “second fixture” as what appears to be two separate embodiments of the invention (plate shaped and a cylindrical cylinder)? Claim Rejections - 35 USC § 102 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale , or otherwise available to the public before the effective filing date of the claimed invention. (a)(2) the claimed invention was described in a patent issued under section 151, or in an application for patent published or deemed published under section 122(b), in which the patent or application, as the case may be, names another inventor and was effectively filed before the effective filing date of the claimed invention. Claim(s) 1-3, 7-9, 13 and 14 are rejected under 35 U.S.C. 102(a)(1) as being anticipated by U.S. Patent No. 10,524,810 ( W alish et al.) . Regarding Claims 1-3, and 7-9 , Walish et al. teaches: Claim 1 - a gripper for gripping an object, the gripper whose one end is connected to a first fixture (226) and the other end is connected to a second fixture (228) , comprising a plurality of twisted loops (218 and 220) each having a predetermined curvature, the plurality of loops (218, 220) gather together ( Figure 3C ) or spread out ( Figure 3B ) to grip or release the object based on relative rotation of the first fixture (226) and the second fixture (228), (Figures 3A-3C); Claim 2 - wherein the first fixture (226) is a plate-shaped first plate (226), the second fixture (228) is a plate-shaped second plate (228), one end of each of the plurality of loops (218 and 220) are coupled to the first plate (226) or extended from the first plate (226), and the other end of each of the plurality of loops (218, 220) are coupled to the second plate (228) or extended from the second plate (228), (Figures 3A-3 C ); Claim 3 - wherein a rotation shaft (230 or 232) rotating the first plate (226) or the second plate (228) is coupled to the first plate (226) or the second plate (228), (Figures 3A-3C); Claim 7 - wherein the first fixture ( element (228) may be considered the first fixture ) is a plate-shaped first plate (228) , and the second fixture ( element (22 6 ) may be considered the second fixture ) is a cylindrical cylinder ( including element (230) ), (Figures 3A-3C); Claim 8 - wherein in the gripper, a rotation shaft (232) is coupled to the first plate (228) to rotate the first plate (228), or rotate the cylindrical cylinder (230), (Figures 3A-3c); Claim 9 - wherein the loop (218 and 220) is a strap having a predetermined elasticity , (Figures 3A-3C) . Regarding Claims 13 and 14 , Walish et al. teaches: Claim 13 – a gripping method for gripping an object by using a loop type gripper, wherein the gripper has one end connected to a first fixture (226) and the other end connected to a second fixture (228) , and includes a plurality of twisted loops (218 and 220) each having a predetermined curvature, the plurality of loops (218 and 220) gather together to grip the object when the first fixture (226) and the second fixture (228) are rotated relative to each other in one direction, and the plurality of loops (218 and 220) each spread out to release the object when the first fixture (226) and the second fixture (228) are rotated relative to each other in the other direction , (Figures 3A-3C); Claim 14 - wherein the relative rotation controls a spread degree of the plurality of loops (218 and 220) based on a size of the object to be gripped, or a gathering degree of the plurality of loops (218 and 220) based on a grip force for gripping the object , (Figures 3A-3C). Allowable Subject Matter Claims 4-6, 10-12, and 15-20 would be allowable if rewritten to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA), 2nd paragraph, set forth in this Office action and to include all of the limitations of the base claim and any intervening claims.
