DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Status of the Application Claims 1-14 are pending. Election/Restrictions Applicant's election without traverse of Group I, claims 1-5, directed to gold nanocluster of formula I, and the species: PNG media_image1.png 358 916 media_image1.png Greyscale in the reply filed on 12/29/2025 is acknowledged. The election was made without traverse. The requirement is therefore made FINAL. Claims 6-14 are withdrawn from further consideration pursuant to 37 CFR 1.142(b), as being drawn to a nonelected invention, there being no allowable generic or linking claim. Applicant is reminded that upon the cancellation of claims to a non-elected invention, the inventorship must be amended in compliance with 37 CFR 1.48(b) if one or more of the currently named inventors is no longer an inventor of at least one claim remaining in the application. Any amendment of inventorship must be accompanied by a request under 37 CFR 1.48(b) and by the fee required under 37 CFR 1.17(i). Claims 1-5 are under current examination. Claim Rejections - 35 USC § 102 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale or otherwise available to the public before the effective filing date of the claimed invention. Claims 1-5 and elected species are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Lee (KR102172084, published 10/30/2020; Machine English translation is used for this rejection). Lee discloses gold nanocluster of formula 1, with same x, y, L1, R1 and R2 along with the synthesis, which is same as described in the instant specification and elected species with x=22, Y=18, same L1, R1 and R2 along with synthesis of elected species (entire patent, specifically examples): PNG media_image2.png 735 943 media_image2.png Greyscale PNG media_image3.png 638 945 media_image3.png Greyscale PNG media_image4.png 748 953 media_image4.png Greyscale PNG media_image5.png 704 968 media_image5.png Greyscale Since the cited prior teaches all of the limitations of the instant claims 1-5, these claims are anticipated.
