DETAILED ACTION
Notice of Pre-AIA or AIA Status
The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA .
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-3 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Regarding claims 1-3, the claimed limitations, ”means for creating a combined (see fig. 6, 618) pre-distorted component by combining each of a plurality of pre-distorted polyphase components, wherein each of the plurality of pre-distorted polyphase components are single phase dependent; and means for feeding the combined pre-distorted component to an output filter to form a pre-distorted transmission signal;”. As stated in the specification 0045 and depicted in Fig. 2, “As illustrated in FIG. 2, the polyphase structure 200 has single phase dependency wherein each parallel pre-distorter 215a, 215b, 215c receives a corresponding output signal from each of the polyphase in put filters 210a, 210b, 210c. The output signals from the parallel pre-distorters 215a, 215b, 215c are filtered again by corresponding polyphase output filters 220a, 220b, 220c, after which the resultant signals are combined and transmitted as a pre-distorted transmission signal y[n] 225.” It is unclear as to how the combined pre-distorted component being created and unclear as to how the combined pre-distorted component is feeding to an output filter (see fig. 2, 220) to form a pre-distorted transmission signal? Appropriate correction required.
Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 1-3 is/are rejected under 35 U.S.C. 102(a) as being anticipated by Gutman et al. (hereinafter “Gutman. US2019/0068133).
As per claim s 1 and 3, Gutman disclosed an apparatus comprising means for receiving (see fig. 6, input signal received at divider 604), at a radio transmitter, a transmission signal for linearization of a power amplifier (see fig. 3, 312, 0028-0030); means for dividing (see fig. 6, divider 604) the transmission signal into a plurality of polyphase components via a plurality of polyphase input filters (see fig. 6, 608) of the radio transmitter; means for pre-distorting (see fig. 6, 612) each of the plurality of polyphase components by feeding each of the plurality of polyphase components to a respective digital predistortion circuit (see fig. 6, 612); means for feeding the output signal of the digital predistortion circuit to an output filter (see fig. 6, 616) to form a pre-distorted transmission signal; and means for generating an output signal by applying the pre-distorted transmission signal to the power amplifier (see fig. 3, 312) to generate an output signal (output signal to antenna 314).
