DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Continued Examination Under 37 CFR 1.114 A request for continued examination under 37 CFR 1.114, including the fee set forth in 37 CFR 1.17(e), was filed in this application after allowance or after an Office action under Ex Parte Quayle, 25 USPQ 74, 453 O.G. 213 (Comm'r Pat. 1935). Since this application is eligible for continued examination under 37 CFR 1.114, and the fee set forth in 37 CFR 1.17(e) has been timely paid, prosecution in this application has been reopened pursuant to 37 CFR 1.114. Applicant's submission filed on 14 May 2026 has been entered. Claim Rejections - 35 USC § 103 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of 35 U.S.C. 103 which forms the basis for all obviousness rejections set forth in this Office action: A patent for a claimed invention may not be obtained, notwithstanding that the claimed invention is not identically disclosed as set forth in section 102, if the differences between the claimed invention and the prior art are such that the claimed invention as a whole would have been obvious before the effective filing date of the claimed invention to a person having ordinary skill in the art to which the claimed invention pertains. Patentability shall not be negated by the manner in which the invention was made. Claim(s) 1 is/are rejected under 35 U.S.C. 103 as being unpatentable over U.S. Patent 5,660,934 to Longo et al. In regards to claim 1, Longo recites a polymer optical fiber (POF) (Figure 2) comprising: a core (30) comprising one or more microcrystalline polyamides (claims 4 & 10); and a cladding (28) comprising one or more fluoropolymers (Column 2, Lines 20-39). Although Longo does not expressly recite wherein the POF has an operating temperature exceeding 150°C and a calculated numerical aperture (NA) of 0.6 or greater, the functional recitation of “having an operating temperature exceeding 150°C and a calculated numerical aperture (NA) of 0.6 or greater” is in the narrative in form. In order to be given patentable weight, a functional recitation must be expressed as a “means” for performing the specified function, as set forth in 35 U.S.C. § 112, 6th paragraph, and must be supported be recitation in the claim of sufficient structure to warrant the presence of the functional language (In re Fuller, 1929 C.D. 172; 388 O.G. 279). Furthermore, an apparatus claim must be structurally distinguishable from the prior art. While features of an apparatus may be recited either structurally or functionally, claims directed to an apparatus must be distinguished from the prior art in terms of structure rather than function (In re Schreiber, 128 F.3d 1473, 1477-78, 44 USPQ2d 1429, 1431-32 (Fed. Cir. 1997); See MPEP 2114 [R-1]). A claim containing a “recitation with respect to the manner in which a claimed apparatus is intended to be employed does not differentiate the claimed apparatus from a prior art apparatus if the prior art apparatus teaches all the structural limitations of the claim (Ex parte Masham, 2 USPQ2d 1647 (Bd. Pat. App. & Inter. 1987); see MPEP 2114 [R-1]). Since Longo recites the claimed structural limitations, it would have been obvious before the effective filing date to a person having ordinary skill in the art for the structure to also have an operating temperature exceeding 150°C and a calculated numerical aperture (NA) of 0.6 or greater for the advantage of the a superior functioning polymer optical fiber. Allowable Subject Matter Claims 4-22 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. The prior art of record fails to disclose or reasonably suggest the limitations of claims 4-22 in addition to the accompanying features of the independent claim and any intervening claims. References Cited The references cited made of record and not relied upon is considered pertinent to applicant’s disclosure. None of the documents cited by the Examiner discloses or reasonably suggests the allowable subject matter discussed above.
