The information disclosure statement (IDS) submitted on 09/14/2023, 11/07/2024, and 12/07/2024 were filed. The submission is in compliance with the provisions of 37 CFR 1.97. Accordingly, the information disclosure statement is being considered by the examiner.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-20 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Regarding claims 1, 11, and 16, the claims recite:
Claims 1, 11, and 16 recited:
“provide an endpoint for a PSP Security Protocol (PSP) connection with a first network interface device”, “provide an endpoint for a PSP… connection with a second network interface device”, “provide a transport layer endpoint for the packets received from the first network interface device”, provide a transport layer endpoint…the second network interface device…”
The limitations are indefinite because the claims do not specify whether the “endpoint” and “transport layer endpoint” for the second network interface device are the same “endpoint” and “transport layer endpoint” used for the first network interface device, respectively.
“perform in-network compute operations…” The term “in-network compute operations” is indefinite because the claims use the term without defining what constitutes an “in-network” operation, and the specification does not provide a clear definition of the term itself. The specification provides examples of compute operations (Spec., ¶0032), such as: “MAC, FMA, FMAC, matrix multiplication, dot product, GEMM… summation… multiplication, division…” However, the specification does not defines what makes a compute operation “in-network”
Because “in-network compute operations” is not a term of art and the specification does not provide clear boundaries for the term, one of ordinary skill in the art cannot determine the scope of the claims with reasonable certainty.
Dependent depend on the rejected claims and are also rejected according.
No prior art is applied at this time due to the indefiniteness of the claims.
