Continued Examination Under 37 CFR 1.114
A request for continued examination under 37 CFR 1.114, including the fee set forth in 37 CFR 1.17(e), was filed in this application after final rejection. Since this application is eligible for continued examination under 37 CFR 1.114, and the fee set forth in 37 CFR 1.17(e) has been timely paid, the finality of the previous Office action has been withdrawn pursuant to 37 CFR 1.114. Applicant's submission filed on 08/12/2026 has been entered.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
Claim 1-2, 4-8, 10-11, 13-15 and 18-20 are rejected under 35 U.S.C. 112(b) paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor, the applicant regards as the invention.
Claim 1 recites limitation “based on a determination that the detected error is caused by the second communication, limit transmission of a reference signal related with the second network through at least one path determined to cause the error of the first communication among the plurality of paths, and transmit the reference signal through one or more paths of the plurality of paths other than the at least one path.” in lines 16-21. The claim is unclear for at least follow reasons:
First, it is unclear whether the limitation “based on the error detected in the second communication” limit the transmission of the reference signal related with the second network would have a result to the transmitting of the reference signal through one or more paths of the plurality of paths other than the at least one path.
Second, it is unclear whether the “transmit the reference signal” through one or more paths of the plurality of paths other than the at least one path that is related to the first or the second network.
In view of above, the claim is indefinite.
For the purpose of examination, examiner will interpret the claims as best understood.
Independent claim 10 discloses the same features as claim 1. Thus, claim 10 is rejected for the same reason as claim 1.
All dependent claims are also rejected since they are depended to rejected claims 1 and 10.
