CTNF 18/232,836 CTNF 95903 DETAILED ACTION Notice of Pre-AIA or AIA Status 07-03-aia AIA 15-10-aia The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA. Claim Rejections - 35 USC § 102 07-06 AIA 15-10-15 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. 07-07-aia AIA 07-07 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – 07-08-aia AIA (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. 07-15 AIA Claim 1 is rejected under 35 U.S.C. 102( a)(1 ) as being anticipated by He (CN 105288989 A). The following is the examiner’s statement of reason for allowance: The prior art does not teach or suggest all elements of Claim 1. [Note that prior art citations are italicized and enclosed in brackets.] Regarding Claim 1, He teaches a skate, comprising: a skate boot and wheel assembly [He “Description” Paragraph 1: “The invention claims a roller skate with a plastic shoe and insole sleeve”] ; an outer seat disposed on the skate boot and wheel assembly [He Figs. 2 and 3, Reference Character 1; Annotated He Fig. 10, below] ; an inner seat disposed in the outer seat [He Fig. 2, Reference Character 12; Annotated He Fig. 10, below] ; a tongue disposed on the inner seat [He Annotated Fig. 10, below] ; a cover disposed on the tongue [He Fig. 7, Reference Character 7; Annotated He Fig. 10, below] ; a first hole disposed in a toe portion of the outer seat; a second hole disposed in front of the first hole; [He Fig. 7, holes into which biasing member Reference Character 6b is inserted] ; a biasing member disposed in both the first and second holes [He Fig. 7, Reference Character 6b; He Paragraph 0034: “the front end of the shoe tongue cover 7 with the shoe 1 at the bottom of the front part is provided with the second torsion spring to make the shoe tongue cover 7 remains forward trend 6b.”] ; two projections having a through hole disposed on a front end of the cover [He Fig. 7, projections hold pivot pin that holds biasing member 6b] ; and a pivot disposed through the through holes and the biasing member to assemble the cover and the outer seat [He Fig. 7; He Annotated Fig. 10, below] .
