Response to Arguments
Applicant’s arguments regarding the 35 U.S.C. 101 rejection of the claims are based on the newly amended subject matter. All arguments are addressed in the 35 U.S.C. 101 rejection of the claims below.
Claim Rejections - 35 USC § 101
35 U.S.C. 101 reads as follows:
Whoever invents or discovers any new and useful process, machine, manufacture, or composition of matter, or any new and useful improvement thereof, may obtain a patent therefor, subject to the conditions and requirements of this title.
Claim(s) 1-5, 7-20 is/are rejected under 35 U.S.C. 101, because the claim(s) is/are directed to an abstract idea, and because the claim elements, whether considered individually or in combination, do not amount to significantly more than the abstract idea, see Alice Corporation Pty. Ltd. V. CLS Bank International et al., 573 US 208 (2014).
Regarding claim 1, the claim is rejected under 35 U.S.C. 101 because the claimed invention is directed to an abstract idea without significantly more.
Step 1 Analysis: Claim 1 is directed to a method, which is directed to a process, one of the statutory categories.
Step 2A Prong One Analysis: The claim recites a(n) method.
The limitation of identifying a plurality of candidate quantum computing chips, each including quantum structures based on Josephson junctions, to be arranged in a candidate quantum computing chips, as drafted, is a process that, under its broadest reasonable interpretation, covers a mental process. The limitation is directed to observation, evaluation, judgment and opinion and is a process capable of being performed by a human mentally or using pen and paper.
The limitation of generating a current optimized tuning plan for the arrangement of the plurality of candidate quantum computing chips in the multi-chip quantum processor, as drafted, is a process that, under its broadest reasonable interpretation, covers a mental process. The limitation is directed to observation, evaluation, judgment and opinion and is a process capable of being performed by a human mentally or using pen and paper.
The limitation of carrying out tuning yield assessment based on the obtained tuning results, as drafted, is a process that, under its broadest reasonable interpretation, covers a mental process. The limitation is directed to observation, evaluation, judgment and opinion and is a process capable of being performed by a human mentally or using pen and paper.
The limitation of repeating the steps of … carrying out tuning yield assessment, based on tuning being incomplete and the current optimized tuning plan remaining viable, as drafted, is a process that, under its broadest reasonable interpretation, covers a mental process. The limitation is directed to observation, evaluation, judgment and opinion and is a process capable of being performed by a human mentally or using pen and paper.
If a claim limitation, under its broadest reasonable interpretation, covers performance of the limitation in the mind, then it falls within the "Mental Processes" grouping. Accordingly, the claim recites an abstract idea.
Step 2A Prong Two Analysis: With respect to the abstract idea, the judicial exception is not integrated into a practical application.
The claim recites additional element(s) – candidate quantum computing chips, candidate quantum computing chips, at least one tuning system. The additional element(s) is/are recited at a high-level of generality (i.e., as generic computer components performing generic computer functions of executing instructions on the computers) such that it amounts to no more than mere instructions to apply the exception using generic computer components (MPEP 2106.05(b)).
The claim recites obtaining results of frequency tuning of structures of the plurality of candidate quantum computer chips, performed by at least one tuning system that tunes quantum structures in accordance with the optimized tuning plan; repeating the steps of obtaining results ..., based on tuning being incomplete and the current optimized tuning plan remaining viable, which is simply receiving data recited at a high level of generality. This is nothing more than insignificant extra-solution activity (MPEP 2106.05(g)).
Accordingly, the additional element(s) do(es) not integrate the abstract idea into a practical application because the additional element(s) do(es) not impose any meaningful limits on practicing the abstract idea, and, therefore, the claim is directed to an abstract idea.
Step 2B Analysis: The claim does not include additional elements that are sufficient to amount to significantly more than the judicial exception. As discussed above with respect to the integration of the abstract idea into a practical application, the additional element(s) of:
candidate quantum computing chips, candidate quantum computing chips, at least one tuning system amount(s) to no more than mere instructions to apply the exception using generic computer components (MPEP 2106.05(b))
receiving data amount(s) to no more than insignificant extra-solution activity (MPEP 2106.05(g)), wherein the insignificant extra-solution activity is the well-understood routine and conventional activit(y/ies) of receiving or transmitting data over a network (MPEP 2016.05(d))
The additional element(s) do(es) not provide an inventive concept, and, therefore, the claim is not patent eligible.
Regarding claim 2, the claim is rejected under 35 U.S.C. 101 because the claimed invention is directed to an abstract idea without significantly more.
Step 1 Analysis: Claim 2 is directed to a method, which is directed to a process, one of the statutory categories.
Step 2A Prong One Analysis: The claim recites a(n) method.
The limitation of responsive to a subsequent determination that the current optimized tuning plan no longer remains viable, generating a new optimized tuning plan, as drafted, is a process that, under its broadest reasonable interpretation, covers a mental process. The limitation is directed to observation, evaluation, judgment and opinion and is a process capable of being performed by a human mentally or using pen and paper.
The limitation of repeating, for the new optimized tuning plan, the steps of … carrying out tuning yield assessment based on tuning being incomplete and the new optimized tuning plan remaining viable, as drafted, is a process that, under its broadest reasonable interpretation, covers a mental process.
The claim recites repeating, for the new optimized tuning plan, the steps of obtaining results ... based on tuning being incomplete and the new optimized tuning plan remaining viable, which is simply receiving data recited at a high level of generality.
As discussed above with respect to the integration of the abstract idea into a practical application, the additional element(s) of:
receiving data amount(s) to no more than insignificant extra-solution activity (MPEP 2106.05(g)), wherein the insignificant extra-solution activity is the well-understood routine and conventional activit(y/ies) of receiving or transmitting data over a network (MPEP 2016.05(d))
The additional element(s) do(es) not provide an inventive concept, and, therefore, the claim is not patent eligible.
Regarding claim 3, the claim is rejected under 35 U.S.C. 101 because the claimed invention is directed to an abstract idea without significantly more.
Step 1 Analysis: Claim 3 is directed to a method, which is directed to a process, one of the statutory categories.
Step 2A Prong One Analysis: The claim recites a(n) method.
The limitation of responsive to a subsequent determination that tuning is complete, carrying out post-tuning analytics, generating a new optimized tuning plan, as drafted, is a process that, under its broadest reasonable interpretation, covers a mental process.
Step 2A Prong Two Analysis: With respect to the abstract idea, the judicial exception is not integrated
into a practical application. The claim does not recite any additional elements which integrate the
abstract idea into a practical application and, therefore, does not impose any meaningful limits on
practicing the abstract idea. Therefore, the claim is directed to an abstract idea.
Step 2B Analysis: The claim does not include additional elements that are sufficient to amount to
significantly more than the judicial exception. As discussed above with respect to the integration of the
abstract idea into a practical application, the claim does not recite any additional elements which
provide an inventive concept, and, therefore, the claim is not patent eligible.
Regarding claim 4, the claim is rejected under 35 U.S.C. 101 because the claimed invention is directed to an abstract idea without significantly more.
Step 1 Analysis: Claim 4 is directed to a method, which is directed to a process, one of the statutory categories.
Step 2A Prong One Analysis: The claim recites a(n) method. The Step 2A Prong One Analysis for claim 1 is applicable here since claim 4 carries out the method of claim 1 but for the recitation of additional element(s) of wherein, in the obtaining step, the results of the tuning comprise LASIQ (Laser Annealing of Stochastically Impaired Qubits) results.
Step 2A Prong Two Analysis: With respect to the abstract idea, the judicial exception is not integrated into a practical application. In particular, the claim recites additional information regarding the data and the element(s) do(es) not apply the exception in a meaningful way (MPEP 2106.05(e)).
As discussed above with respect to the integration of the abstract idea into a practical application, the additional element(s) of additional information regarding the data do(es) not apply the exception in a meaningful way (MPEP 2106.05(e)). Not applying the exception in a meaningful way does not provide an inventive concept, and, therefore, the claim is not patent eligible.
Regarding claim 5, the claim is rejected under 35 U.S.C. 101 because the claimed invention is directed to an abstract idea without significantly more.
Step 1 Analysis: Claim 5 is directed to a method, which is directed to a process, one of the statutory categories.
Step 2A Prong One Analysis: The claim recites a(n) method. The Step 2A Prong One Analysis for claim 4 is applicable here since claim 5 carries out the method of claim 4 but for the recitation of additional element(s) of wherein the results of the tuning are obtained at a central server computer from multiple LASIQ (Laser Annealing of Stochastically Impaired Qubits) machines.
Step 2A Prong Two Analysis: With respect to the abstract idea, the judicial exception is not integrated into a practical application.
The claim recites additional element(s) – central server computer, multiple LASIQ (Laser Annealing of Stochastically Impaired Qubits) machines. The additional element(s) is/are recited at a high-level of generality (i.e., as generic computer components performing generic computer functions of executing instructions on the computers) such that it amounts to no more than mere instructions to apply the exception using generic computer components (MPEP 2106.05(b)).
The claim recites wherein the results of the tuning are obtained at a central server computer from multiple LASIQ (Laser Annealing of Stochastically Impaired Qubits) machines, which is simply transmitting and/or storing data recited at a high level of generality.
As discussed above with respect to the integration of the abstract idea into a practical application, the additional element(s) of:
central server computer, multiple LASIQ (Laser Annealing of Stochastically Impaired Qubits) machines amount(s) to no more than mere instructions to apply the exception using generic computer components (MPEP 2106.05(b))
transmitting and/or storing data amount(s) to no more than insignificant extra-solution activity (MPEP 2106.05(g)), wherein the insignificant extra-solution activity is the well-understood routine and conventional activit(y/ies) of receiving or transmitting data over a network and/or storing and retrieving information in memory (MPEP 2016.05(d))
The additional element(s) do(es) not provide an inventive concept, and, therefore, the claim is not patent eligible.
Regarding claim 7, the claim is rejected under 35 U.S.C. 101 because the claimed invention is directed to an abstract idea without significantly more.
Step 1 Analysis: Claim 7 is directed to a method, which is directed to a process, one of the statutory categories.
Step 2A Prong One Analysis: The claim recites a(n) method. The Step 2A Prong One Analysis for claim 1 is applicable here since claim 7 carries out the method of claim 1 but for the recitation of additional element(s) of wherein generating the current optimized tuning plan for the arrangement of the plurality of candidate quantum computing chips in the multi-chip quantum processor comprises applying a linear chip build approach.
Step 2A Prong Two Analysis: With respect to the abstract idea, the judicial exception is not integrated into a practical application.
The claim recites wherein generating the current optimized tuning plan for the arrangement of the plurality of candidate quantum computing chips in the multi-chip quantum processor comprises applying a linear chip build approach which is simply additional information regarding the tuning, and the element(s) do(es) not apply the exception in a meaningful way (MPEP 2106.05(e)).
The claim recites additional element(s) – linear chip build approach. The additional element(s) is/are recited at a high-level of generality such that it amounts to no more than indicating a field of use or technological environment in which to apply the judicial exception (MPEP 2106.05(h)).
As discussed above with respect to the integration of the abstract idea into a practical application, the additional element(s) of:
linear chip build approach amount(s) to no more than indicating a field of use or technological environment in which to apply the judicial exception (MPEP 2106.05(h))
additional information regarding the tuning do(es) not apply the exception in a meaningful way (MPEP 2106.05(e))
The additional element(s) do(es) not provide an inventive concept, and, therefore, the claim is not patent eligible.
Regarding claim 8, the claim is rejected under 35 U.S.C. 101 because the claimed invention is directed to an abstract idea without significantly more.
Step 1 Analysis: Claim 8 is directed to a method, which is directed to a process, one of the statutory categories.
Step 2A Prong One Analysis: The claim recites a(n) method.
The limitation of selecting, from the stock, a top ranked chip by estimated functional yield, as drafted, is a process that, under its broadest reasonable interpretation, covers a mental process. The limitation is directed to observation, evaluation, judgment and opinion and is a process capable of being performed by a human mentally or using pen and paper.

Step 1 Analysis: Claim 9 is directed to a method, which is directed to a process, one of the statutory categories.
Step 2A Prong One Analysis: The claim recites a(n) method. The Step 2A Prong One Analysis for claim 1 is applicable here since claim 9 carries out the method of claim 1 but for the recitation of additional element(s) of wherein generating the current optimized tuning plan for the arrangement of the plurality of candidate quantum computing chips in the multi-chip quantum processor comprises applying deterministic tuning.

The claim recites repeating, for the new optimized tuning plan, the steps of obtaining results … based on tuning being incomplete and the new optimized tuning plan remaining viable, which is simply receiving data recited at a high level of generality.
As discussed above with respect to the integration of the abstract idea into a practical application, the additional element(s) of:
receiving data amount(s) to no more than insignificant extra-solution activity (MPEP 2106.05(g)), wherein the insignificant extra-solution activity is the well-understood routine and conventional activit(y/ies) of receiving or transmitting data over a network (MPEP 2016.05(d))
The additional element(s) do(es) not provide an inventive concept, and, therefore, the claim is not patent eligible.
Regarding claim 15, the claim is rejected under 35 U.S.C. 101 because the claimed invention is directed to an abstract idea without significantly more.
Step 1 Analysis: Claim 15 is directed to a system with a processor, which is directed to a machine, one of the statutory categories.
Step 2A Prong One Analysis: The claim recites a(n) system.
The limitation of identify a plurality of candidate quantum computing chips, each comprising quantum structures that include Josephson junctions, to be arranged in a multi-chip quantum processor, as drafted, is a process that, under its broadest reasonable interpretation, covers a mental process. The limitation is directed to observation, evaluation, judgment and opinion and is a process capable of being performed by a human mentally or using pen and paper.
The limitation of generate a current optimized tuning plan for the arrangement of the plurality of candidate quantum computing chips in the multi-chip quantum processor, as drafted, is a process that, under its broadest reasonable interpretation, covers a mental process. The limitation is directed to observation, evaluation, judgment and opinion and is a process capable of being performed by a human mentally or using pen and paper.
The limitation of carry out tuning yield assessment based on the obtained tuning results, as drafted, is a process that, under its broadest reasonable interpretation, covers a mental process. The limitation is directed to observation, evaluation, judgment and opinion and is a process capable of being performed by a human mentally or using pen and paper.
The limitation of repeat … the carrying out of the tuning yield assessment, based on tuning being incomplete and the current optimized tuning plan remaining viable, as drafted, is a process that, under its broadest reasonable interpretation, covers a mental process.
The claim recites additional element(s) – system, memory, at least one processor, candidate quantum computing chips, candidate quantum computing chips, at least one tuning system. The additional element(s) is/are recited at a high-level of generality (i.e., as generic computer components performing generic computer functions of executing instructions on the computers) such that it amounts to no more than mere instructions to apply the exception using generic computer components (MPEP 2106.05(b)).
The claim recites obtain results of frequency tuning of the quantum structures of the plurality of candidate quantum computing chips performed by at least one tuning system in accordance with the optimized tuning plan; repeat the obtaining of the results ..., based on tuning being incomplete and the current optimized tuning plan remaining viable, which is simply receiving data recited at a high level of generality.
As discussed above with respect to the integration of the abstract idea into a practical application, the additional element(s) of:
system, memory, at least one processor, candidate quantum computing chips, candidate quantum computing chips, at least one tuning system amount(s) to no more than mere instructions to apply the exception using generic computer components (MPEP 2106.05(b))
receiving data amount(s) to no more than insignificant extra-solution activity (MPEP 2106.05(g)), wherein the insignificant extra-solution activity is the well-understood routine and conventional activit(y/ies) of receiving or transmitting data over a network (MPEP 2016.05(d))
The additional element(s) do(es) not provide an inventive concept, and, therefore, the claim is not patent eligible.
Regarding claim 16, the claim is rejected under 35 U.S.C. 101 because the claimed invention is directed to an abstract idea without significantly more.
Step 1 Analysis: Claim 16 is directed to a system with a processor, which is directed to a machine, one of the statutory categories.
Step 2A Prong One Analysis: The claim recites a(n) system.
The limitation of responsive to a subsequent determination that the current optimized tuning plan no longer remains viable, generate a new optimized tuning plan, as drafted, is a process that, under its broadest reasonable interpretation, covers a mental process. The limitation is directed to observation, evaluation, judgment and opinion and is a process capable of being performed by a human mentally or using pen and paper.
The limitation of repeat, for the new optimized tuning plan, … the carrying out of the tuning yield assessment based on tuning being incomplete and the new optimized tuning plan remaining viable, as drafted, is a process that, under its broadest reasonable interpretation, covers a mental process.
The claim recites repeat, for the new optimized tuning plan, the obtaining of the results ... based on tuning being incomplete and the new optimized tuning plan remaining viable, which is simply receiving data recited at a high level of generality.
As discussed above with respect to the integration of the abstract idea into a practical application, the additional element(s) of:
receiving data amount(s) to no more than insignificant extra-solution activity (MPEP 2106.05(g)), wherein the insignificant extra-solution activity is the well-understood routine and conventional activit(y/ies) of receiving or transmitting data over a network (MPEP 2016.05(d))
The additional element(s) do(es) not provide an inventive concept, and, therefore, the claim is not patent eligible.
Regarding claim 17, the claim is rejected under 35 U.S.C. 101 because the claimed invention is directed to an abstract idea without significantly more.
Step 1 Analysis: Claim 17 is directed to a system with a processor, which is directed to a machine, one of the statutory categories.
Step 2A Prong One Analysis: The claim recites a(n) system.
The limitation of responsive to a subsequent determination that tuning is complete, carry out post-tuning analytics, as drafted, is a process that, under its broadest reasonable interpretation, covers a mental process.
Regarding claim 18, the claim is rejected under 35 U.S.C. 101 because the claimed invention is directed to an abstract idea without significantly more.
Step 1 Analysis: Claim 18 is directed to a system with a processor, which is directed to a machine, one of the statutory categories.
Step 2A Prong One Analysis: The claim recites a(n) system. The Step 2A Prong One Analysis for claim 15 is applicable here since claim 18 carries out the system of claim 15 but for the recitation of additional element(s) of wherein the results of the tuning comprise LASIQ (Laser Annealing of Stochastically Impaired Qubits) results.
Step 2A Prong Two Analysis: With respect to the abstract idea, the judicial exception is not integrated into a practical application. In particular, the claim recites additional information regarding the data and the element(s) do(es) not apply the exception in a meaningful way (MPEP 2106.05(e)).
Regarding claim 19, the claim is rejected under 35 U.S.C. 101 because the claimed invention is directed to an abstract idea without significantly more.
Step 1 Analysis: Claim 19 is directed to a system with a processor, which is directed to a machine, one of the statutory categories.
Step 2A Prong One Analysis: The claim recites a(n) system. The Step 2A Prong One Analysis for claim 18 is applicable here since claim 19 carries out the system of claim 18 but for the recitation of additional element(s) of wherein the memory and at least one processor are associated with a central server computer.
Step 2A Prong Two Analysis: With respect to the abstract idea, the judicial exception is not integrated into a practical application.
The claim recites wherein the memory and at least one processor are associated with a central server computer which is simply additional information regarding the hardware, and the element(s) do(es) not apply the exception in a meaningful way (MPEP 2106.05(e)).
The claim recites additional element(s) – central server computer. The additional element(s) is/are recited at a high-level of generality (i.e., as generic computer components performing generic computer functions of executing instructions on the computers) such that it amounts to no more than mere instructions to apply the exception using generic computer components (MPEP 2106.05(b)).
As discussed above with respect to the integration of the abstract idea into a practical application, the additional element(s) of:
central server computer amount(s) to no more than mere instructions to apply the exception using generic computer components (MPEP 2106.05(b))
additional information regarding the hardware do(es) not apply the exception in a meaningful way (MPEP 2106.05(e))
The additional element(s) do(es) not provide an inventive concept, and, therefore, the claim is not patent eligible.
Regarding claim 20, the claim is rejected under 35 U.S.C. 101 because the claimed invention is directed to an abstract idea without significantly more.
Step 1 Analysis: Claim 20 is directed to a system with a processor, which is directed to a machine, one of the statutory categories.
Step 2A Prong One Analysis: The claim recites a(n) system. Step 2A Prong Two Analysis: With respect to the abstract idea, the judicial exception is not integrated into a practical application.
The claim recites additional element(s) – multiple LASIQ (Laser Annealing of Stochastically Impaired Qubits) machines. The additional element(s) is/are recited at a high-level of generality (i.e., as generic computer components performing generic computer functions of executing instructions on the computers) such that it amounts to no more than mere instructions to apply the exception using generic computer components (MPEP 2106.05(b)).
The claim recites wherein the tuning results are obtained from the multiple LASIQ (Laser Annealing of Stochastically Impaired Qubits) machines, which is simply transmitting data recited at a high level of generality.
As discussed above with respect to the integration of the abstract idea into a practical application, the additional element(s) of:
multiple LASIQ (Laser Annealing of Stochastically Impaired Qubits) machines amount(s) to no more than mere instructions to apply the exception using generic computer components (MPEP 2106.05(b))
transmitting data amount(s) to no more than insignificant extra-solution activity (MPEP 2106.05(g)), wherein the insignificant extra-solution activity is the well-understood routine and conventional activit(y/ies) of receiving or transmitting data over a network and/or storing and retrieving information in memory (MPEP 2016.05(d))
The additional element(s) do(es) not provide an inventive concept, and, therefore, the claim is not patent eligible.
Allowable Subject Matter
Claim(s) 6 is/are allowed.
The following is an examiner’s statement of reasons for allowance: in view of claim(s) 6 and further search, claim(s) 6 is/are considered allowable since when reading claim(s) 6 in light of the specification, as per MPEP 2111.01, none of the references of record either alone or in combination fairly disclose or suggest the combination of limitations specified in claim(s) 6, including at least:
Claim 6 (limitations from claim 1):
...
identifying a plurality of candidate quantum computing chips to be arranged in a multi-chip quantum processor;
generating a current optimized tuning plan for the arrangement of the plurality of candidate quantum computing chips in the multi-chip quantum processor;
...
Regarding the limitation(s) of claim(s) 6 which do(es) not appear to be taught by the prior art: Zhang et al. (both references) teaches identifying processor candidates for a tuning plan and tuning yield assessment. Hertzberg et al. teaches frequency tuning with laser annealing and tuning yield assessment.
However, claim(s) 6 is/are deemed to be directed to a nonobvious improvement over the prior art of record. As noted above, claim(s) 6 comprise(s) a tuning plan and tuning yield assessment on a plurality of quantum chips for arrangement in a multi-chip quantum processor.
Therefore, the cited/applied prior art fails to teach or suggest each and every feature of each of the combination of features recited in claim(s) 6.
When taken into context, claim(s) 6 as a whole was not uncovered in the prior art.
