Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claim 4 is rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention. The metes and bounds of claim 4 are indefinite, since it depends from itself.
Claims 1-3 and 5-8 are allowed.
The following is a statement of reasons for the indication of allowable subject matter: KR 1023550088B1 discloses a silicon manufacturing device comprising a raw material container into which raw materials including silica and carbon are loaded; a reaction chamber in which the raw material container is accommodated; and a laser generating device for irradiating a laser onto the raw material container within the reaction chamber. (See claim 9 and Paragraph [0025] of the English translation.) However there is no teaching, disclosure or suggestion in the reference to include a motor and provide rotational force from the motor to rotate the raw material container, as required by applicant’s claims. Nor would there be any motivation from the prior art to modify the apparatus of KR 102355088B1 with such feature. Accordingly claims 1-3 and 5-8 are not rejected over KR 1023550088B1.
Laine et al (US 2011/0206591) is made of record for disclosing a plasma process for producing silanes.
DE 102011000543A1 is made of record for disclosing the carbothermic reduction of metal oxides to the corresponding metals.
CN 110040734A is made of record for disclosing a method for preparing nano silicon by sintering a mixture of silica powder and graphene powder.
CHO et al (US 2017/0190584) is made of record for disclosing a method for preparing nanoparticles using a laser beam.
