Claim Rejections - 35 USC § 102 07-06 AIA 15-10-15 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. 07-07-aia AIA 07-07 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – 07-08-aia AIA (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. 07-15 AIA Claim (s) 16,18 are rejected under 35 U.S.C. 102( a)(1 ) as being anticipated by JP 2014151722 A to Yusuke (Machine Translation) . Regarding claim 16: Yusuke at least discloses and shows in Figs. 1-3 : An energy storage apparatus (forklift 1 with fuel cell unit 10 having battery as auxiliary power; see [0017]) comprising: a casing (casing 13) ; a battery pack (included in fuel cell unit 10 as auxiliary power source which stores surplus power; see [0014],[0017]) disposed inside the casing (13) , and having a plurality of battery cells (examiner notes that a forklift vehicle is a heavy equipment vehicle and thus requires a high voltage battery which necessarily has a plurality of battery cells) ; a power converter (DC/DC converter 25)(see [0027],[0032]-[0033]) disposed inside the casing (13)(see Figs. 2-3) , and configured to charge or discharge the plurality of battery cells (11 or (10->combo 11/battery, fuel cell unit 15); see [0027]) ; a pump (19)(see [0028]) configured to provide cooling liquid to the battery pack (10->combo 11/battery, fuel cell unit 15) or the power converter (25)(see [0028]) ; and a heat radiator (17) configured to cool (note-The radiator 17 has a pipe in which the coolant flows; see [0020]) the cooling liquid flowing from the battery pack (10->combo 11/battery) or the power converter (25)(see [0030]-[0032]) , wherein the heat radiator (17) includes: a housing disposed on the casing (13) , and configured to form a heat exchange space that has a first chamber (15c) and a second chamber (space between the air filter 22 and the fuel cell 11)([0020]-[0022]) ; a heat sink (23) disposed in the heat exchange space of the housing (13) ; a cooling pipe (radiator 17 has a pipe in which the coolant flow; see [0020]) disposed in the first chamber (15c) and to directly contact the heat sink (23) ; and a heat sink fan (18) disposed in the second chamber (space between the air filter 22 and the fuel cell 11) , and configured to provide an air flow in the second chamber (note-heat exchange between the air supplied by the radiator cooling fan 18 and passing between the pipes in the radiator 17 and the coolant in the pipe is carried out. Is configured to cool. The pipe in the radiator 17 communicates with the inside of the fuel cell 11 through a pipe, and the coolant for the fuel cell 11 is provided by a water pump 19 provided in the middle of the pipe and arranged in the accessory space 15c; see [0020]) . Regarding claim 18. Yusuke discloses all the claimed invention as set forth and discussed above in claim 16. Yusuke further discloses, wherein a plurality of heat sink fins (23d)([0022]) are disposed in the second chamber to guide air (via 2e,2b)([0028]) admitted through the communicating holes (construed as gaps formed between the radiation fins 23d and the upstream mounting plate 23a, and between the radiation fins 23d and the downstream mounting plate 23b; see [0022]) to the heat sink fan (18)([0032]-[0033]) . Allowable Subject Matter 12-151-08 AIA 07-43 12-51-08 Claim 17 is objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. Regarding claim 17, patentability exists at least in part with the claimed limitations of, wherein the heat sink fan is disposed on one side of the housing, and the housing includes a plurality of communicating holes vertically spaced out below the heat sink fan, wherein the plurality of communicating holes are provided between the second chamber and outside of the housing to allow the air to flow in the second chamber. 12-151-07 AIA 07-97 12-51-07 Claim s 1-15,19-20 are allowed. The prior art of record either taken alone or in combination thereof fails to teach or reasonably suggest in the claimed combination, inter alia, As in claim 1: An energy storage apparatus comprising … a heat radiator configured to cool the cooling liquid flowing from the battery pack or the power converter, wherein the heat radiator includes: a cooling pipe configured to guide flow of the cooling liquid; a heat sink having a first side that contacts the cooling pipe and a second side having a plurality of heat sink fins disposed on the second side; a heat sink fan disposed on one side of the heat sink, and configured to provide an air flow to the plurality of heat sink fins; and a cover plate spaced from the heat sink in a first direction, and having a plurality of communicating holes through which air is to flow to the heat sink fins. As in claim 19: An energy storage apparatus comprising… a first heat radiator configured to cool the cooling liquid flowing from the battery pack or the power converter; a second heat radiator configured to cool the cooling liquid flowing from the battery pack or the power converter; and a regulating valve configured to selectively control the cooling liquid to the first heat radiator and the second heat radiator, wherein the regulating valve is configured to supply the cooling liquid to the second heat radiator alone when a temperature of the cooling liquid is less than or equal to a set temperature. Claims 2-15 depend either directly or indirectly from claim 1 and therefore are allowed for the same reasons. Claim 20 depends directly from claim 19 and therefore is allowed for the same reasons.
