DETAILED ACTION Notice of Pre-AIA or AIA Status The present application, filed on or after March 16, 2013, is being examined under the first inventor to file provisions of the AIA . Status of the Application Claims 1-2 are pending. Election/Restrictions Applicant's election without traverse of species of 3b: PNG media_image1.png 264 372 media_image1.png Greyscale in the reply filed on 02/12/2026 is acknowledged. The requirement is therefore made FINAL. Applicant is reminded that upon the cancellation of claims to a non-elected invention, the inventorship must be amended in compliance with 37 CFR 1.48(b) if one or more of the currently named inventors is no longer an inventor of at least one claim remaining in the application. Any amendment of inventorship must be accompanied by a request under 37 CFR 1.48(b) and by the fee required under 37 CFR 1.17(i). Claims 1-2 are under current examination. Claim Objections Claim 2 is objected to because of missing period at the end of the claim. Appropriate correction is required. Claim Rejections - 35 USC § 102 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale or otherwise available to the public before the effective filing date of the claimed invention. Claims 1-2 and elected species are rejected under 35 U.S.C. 102(a)(1) as being anticipated by Shen (CN101570550 B; as provided by the applicant on IDS dated 12/01/2025; Machine English translation is used for this rejection). Shen discloses synthesis of mixture comprising compound 3b comprising reacting N, N-dimethyl-1-ferrocenylethylamine in the presence of alkyl lithium and a chlorodiarylphosphine to obtain a mixture of (diarylphosphino)ferrocenylethylamine and subsequently reacting it with bis(3,5-dimethylaryl)phosphine in presence of organic acid to form mixture comprising compound 3b (entire publication): PNG media_image2.png 738 765 media_image2.png Greyscale PNG media_image3.png 223 809 media_image3.png Greyscale PNG media_image4.png 874 720 media_image4.png Greyscale PNG media_image5.png 328 757 media_image5.png Greyscale PNG media_image6.png 145 785 media_image6.png Greyscale Since the cited prior art reads on all the limitations of the instant claims 1-2, these claims are anticipated. Citation of Relevant Prior art The following references has been made of record but not relied upon is considered pertinent to applicant’s disclosure. Following is the relevance of the prior art made of record: U.S. 2007/0161762 A1: The cited prior art teaches a method of preparing compound 3b using same starting material and reacting with dichloroarylphosphine in presence of alkyl lithium followed by treatment with aryl halide in presence of alkyl lithium to form same compound as in step a of the instant claims followed by same step b as in the instant claims. Thus, the cited prior art differs with respect to phosphine compound used in step a of the instant claims. Conclusion No Claim is allowed.
