Continued Examination Under 37 CFR 1.114
A request for continued examination under 37 CFR 1.114, including the fee set forth in 37 CFR 1.17(e), was filed in this application after final rejection. Since this application is eligible for continued examination under 37 CFR 1.114, and the fee set forth in 37 CFR 1.17(e) has been timely paid, the finality of the previous Office action has been withdrawn pursuant to 37 CFR 1.114. Applicant's submission filed on December 12th 2025 has been entered.
Claim Rejections - 35 USC § 112
The following is a quotation of 35 U.S.C. 112(b):
(b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention.
The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph:
The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention.
Claims 1-3 and 7-17 rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being indefinite for failing to particularly point out and distinctly claim the subject matter which the inventor or a joint inventor (or for applications subject to pre-AIA 35 U.S.C. 112, the applicant), regards as the invention.
Claim 1 recites the limitation “the at least one patch interlayer is a transparent polymer interlayer” and “a feeding network attached and separated by a feed interlayer from the second transparent dielectric panel” which render the claim indefinite.
Regarding the at least one patch interlayer being a transparent polymer interlayer has insufficient antecedent basis since the claim only recites a single patch interlayer and never recites having more than one.
It is further unclear how the feeding network can be separated from the second dielectric panel by a feed interlay when the claim also recites that the ground plane is between the feeding network and second dielectric panel. It seems said limitation is only true in the embodiment of figure 2 wherein the rest of the claim speaks to the embodiment of figure 3. Therefore for the purposes of examination, the examiner, as best understood will interpret the limitation to mean “the patch interlayer is a transparent polymer interlayer” and “a feeding network (F) attached and separated by a feed interlayer (If), a ground plane, a third layer transparent layer, and a ground interlayer, from the second transparent dielectric panel” to bring the claim more in line with the specifications and figure 3 of the drawing.
Claim 2-3 and 7-17 inherit the indefiniteness of claim 1.
Allowable Subject Matter
Claim 14 would be allowable if rewritten or amended to overcome the rejection(s) under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), 2nd paragraph, set forth in this Office action.
The following is a statement of reasons for the indication of allowable subject matter: Regarding claim 14, patentability exists, at least in part, with the claimed features of a tightening means between the four corner elements to tighten the four corner elements.
Joulaud (FR 2981929A1) and Dai (US 9564674B2) are both cited as teaching some elements of the claimed invention including a first transparent dielectric layer, second transparent dielectric layer, a transparent antenna structure, and a housing with 4 corner elements.
However, the prior art when taken alone, or in combination, cannot be construed as reasonably teaching or suggesting all of the elements of the claimed invention as arranged, disposed, or provided in the manner as claimed by the applicant.

The prior art made of record and not relied upon is considered pertinent to applicant's disclosure
US 11114742 B2 (Shrivastava; Dhairya et al.) relates to a configuration of a window antenna inside a frame with radiating patch elements.
