Priority Acknowledgment is made of applicant's claim for domestic priority under 35 U.S.C. § 119(e). Information Disclosure Statement Note the attached PTO-1449 forms submitted with the Information Disclosure Statement filed with the RCE. Specification The abstract is acceptable. The title is acceptable. Continued Examination Under 37 CFR 1.114 A request for continued examination under 37 CFR 1.114, including the fee set forth in 37 CFR 1.17(e), was filed in this application after allowance or after an Office action under Ex Parte Quayle, 25 USPQ 74, 453 O.G. 213 (Comm'r Pat. 1935). Since this application is eligible for continued examination under 37 CFR 1.114, and the fee set forth in 37 CFR 1.17(e) has been timely paid, prosecution in this application has been reopened pursuant to 37 CFR 1.114. Applicant's submission filed on 29 MAY 2026 has been entered and the IDS filed therewith has been considered. Claim Rejections - 35 USC § 112 The following is a quotation of 35 U.S.C. 112(b): (b) CONCLUSION.—The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the inventor or a joint inventor regards as the invention. The following is a quotation of 35 U.S.C. 112 (pre-AIA ), second paragraph: The specification shall conclude with one or more claims particularly pointing out and distinctly claiming the subject matter which the applicant regards as his invention. Upon further consideration and review mandated by the RCE filing, claims 3, 6, and 7 are rejected under 35 U.S.C. 112(b) or 35 U.S.C. 112 (pre-AIA ), second paragraph, as being incomplete for omitting essential structural cooperative relationships of elements, such omission amounting to a gap between the necessary structural connections. See MPEP § 2172.01: Failing to claim the subject matter that the inventor or a joint inventor (or, for applications subject to pre-AIA 35 U.S.C. 112, the applicant) regards as the invention (see, e.g., In re Collier, 397 F.2d 1003, 158 USPQ 266 (CCPA 1968)). Such essential matter may include missing elements, steps or necessary structural cooperative relationships of elements described by the applicant(s) as necessary to practice the invention. The omitted structural cooperative relationships are between the mixing chamber of claims 3, 6, and 7 and the elements (a) mixing apparatus; (b) drying apparatus; and (c) discharge apparatus of claim 1. Since the elements (a) - (c) could each comprise a mixing chamber, it is unclear which of these elements include such mixing chamber. Compare with the clear and definite language of claim 22, penultimate line and claim 23, lines 24-25. Claims 3, 6, and 7 should emulate this definite language for clarity and definiteness. Claim Interpretation Pursuant to 35 U.S.C. § 112, sixth paragraph (NOT a rejection, merely claim interpretation to clarify the record) The following is a quotation of 35 U.S.C. 112(f): (f) Element in Claim for a Combination. – An element in a claim for a combination may be expressed as a means or step for performing a specified function without the recital of structure, material, or acts in support thereof, and such claim shall be construed to cover the corresponding structure, material, or acts described in the specification and equivalents thereof. The following is a quotation of pre-AIA 35 U.S.C. 112, sixth paragraph: An element in a claim for a combination may be expressed as a means or step for performing a specified function without the recital of structure, material, or acts in support thereof, and such claim shall be construed to cover the corresponding structure, material, or acts described in the specification and equivalents thereof. See Applicant’s remarks filed 22 JAN 2026 which are agreed with upon reconsideration. Allowable Subject Matter Claims 1, 2, 11-14, 16-17, 19-20, 22-23, 28, 30-34 stand allowed. Claims 3, 6, and 7 would be allowable if rewritten or amended to overcome the rejection under 35 U.S.C. 112(b) set forth in this Office action.
