Priority 02-26 AIA Receipt is acknowledged of papers submitted under 35 U.S.C. 119(a)-(d), which papers have been placed of record in the file. Information Disclosure Statement The information disclosure statement (IDS) submitted on 06/13/2023 is acknowledged by the examiner. Claim Rejections - 35 USC § 102 07-06 AIA 15-10-15 In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status. 07-07-aia AIA 07-07 The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action: A person shall be entitled to a patent unless – 07-08-aia AIA (a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention. 07-15 AIA Claim 1 is rejected under 35 U.S.C. 102( a)(1 ) as being anticipated by Tamai (US 5.898.293) . PNG media_image1.png 608 1098 media_image1.png Greyscale As to claim 1 , Tamai discloses in figure 2 (see figure above),a removable battery pack [figure 2 shows a battery pack with protection circuit] comprising: a monitoring unit [controller unit (25); the IC monitors battery (21) to determine over-discharge or over-charge state of the battery; see also Col. 4. Ines 5-10]; an electromechanical interface including a plurality of electrical contacts [electrical contacts (28) and (29); see figure above], a first electrical contact configured to serve [the first contact 28] as a first power supply contact [element (28) is a positive potential terminal for the battery pack], to which a first reference potential is , applied [the positive potential of the battery is applied], and a second electrical contact configured to serve as a second power supply contact [element 29 is negative potential terminal or the battery pack], to which a second reference potential applied [negative potential of the battery applied; see also Col. 4, lines 17-30]; and at least one first switching element [see figure 2, element 23; see also figure above] configured to interrupt or enable a charging or discharging current across the first power supply contact and the second power supply contact [noted that the switching element (23) is used to interrupt the discharge of the battery voltage; see also Col. 5, 4, lines 41-67 and Col. 5, lines 1-25 ] wherein the monitoring unit [IC circuit (25)] is configured to control the at least one first switching element based on a switching potential [noted that the switching potintal is the battery potential and detected by IC (25)] , wherein the switching potential is directly derived from the first reference potential [when the potential of the battery pack voltage is below the reference the switch interrupts the flow of discharging current; see Col. 5, 4, lines 41-67 and Col. 5, lines 1-25] wherein the switching potential is decoupled with respect to voltage fluctuations and voltage drops of the first reference potential [noted that the control IC (25) detects the battery voltage and when the battery voltage is below over-discharge threshold the switch (23) will be in off position and the battery will be disconnected from the load. This process is based on abnormality which depends on battery or cell voltage fluctuation and over-discharge value/reference value; see Abstract and also ¶0034-0035 ] . Allowable Subject Matter 12-151-08 AIA 07-43 12-51-08 Claim s 2-11 are objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims. For Claim 2 :Primarily, the prior art of record does not disclose or suggest in the claimed combination: wherein: the switching potential is formed by an a resistor-capacitor element (RC element), the RC element consists of at least one resistor and at least one capacitor ,the RC element is switched between the first reference potential and the second reference potential , and the switching potential is applied between the at least one resistor and the at least one capacitor of the RC element.
