Claim Rejections - 35 USC § 102
In the event the determination of the status of the application as subject to AIA 35 U.S.C. 102 and 103 (or as subject to pre-AIA 35 U.S.C. 102 and 103) is incorrect, any correction of the statutory basis (i.e., changing from AIA to pre-AIA ) for the rejection will not be considered a new ground of rejection if the prior art relied upon, and the rationale supporting the rejection, would be the same under either status.
The following is a quotation of the appropriate paragraphs of 35 U.S.C. 102 that form the basis for the rejections under this section made in this Office action:
A person shall be entitled to a patent unless –
(a)(1) the claimed invention was patented, described in a printed publication, or in public use, on sale, or otherwise available to the public before the effective filing date of the claimed invention.
Claim(s) 1-6 and 8-15 is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by WO2015086667 issued to Glinka. Glinka discloses a bogie 10 for a rail-based vehicle, the bogie 10 comprising: one or more rail wheels (14.1, 14.2), each rail wheel arrangement comprising a first rail wheel 14.1, and a second, different rail wheel 14.2; a motor arrangement comprising one or more electrical motors (30.1, 30.2) configured to drive rail wheels (14.1, 14.2) and an inverter (42.1, 42.2) for each wheel (14.1, 14.2), the inverters (42.1, 42.2) receiving power from a battery 40; a cooling system (see paragraph [0069] of espacenet.com translation)

Figure 5 shows the rail vehicle 12 with a car body 26, which is supported on the roadway 16 by means of the chassis unit 10.
The chassis unit 10 can be designed in the version shown in Figures 1 to 3 or in the version shown in Figure 4. The connection between the intermediate circuit 43 and the power supply unit 40 is made by means of cable connections 81, which carry a DC voltage. A cable path, via which an alternating current generated by the power supply unit 40 is routed to the traction motors 30, is located exclusively within the chassis unit 10 and is therefore designed to be short. In addition to the cable connections 81, a water cooling line and/or control lines may also be routed from the car body 26 to the chassis unit 10 (not shown). Figure 6 shows another embodiment of the invention. This figure shows the car body 26 and the chassis unit 10 coupled to it. The following text is limited to the differences from the designs shown in Figures 1 to 3 and in Figure 4. Furthermore, the reference symbols from the above-described statements will be retained.
The design according to Figure 6 differs in that the power supply unit 40 is carried by the car body 26. For example, this can be done by means of fastening elements 82, by which a mounting unit 84 is attached to the car body 26. Alternatively or additionally, the assembly unit can be at least partially comprised of the power supply unit, e.g. B. a housing part, be self-formed, whereby this part of the power supply unit is then directly attached to the other component
There does not appear to be any disclosure related to drawing power from an external power source so claim 14 is interpreted as being anticipated. The rail-based vehicle is positively recited in claim 15 so the weight of the vehicle does not serve to further limit the claim.
Claim(s) 1-4 and 8-15 are is/are rejected under 35 U.S.C. 102(a)(1) as being anticipated by WO2008134860 issued to Mai. Mai disclose a bogie for a rail based vehicle comprising first and second rail wheels; a motor 3 to drive the wheels; an inverter 2 converting power from a battery; an inverter controller 4

Claim 7 is objected to as being dependent upon a rejected base claim, but would be allowable if rewritten in independent form including all of the limitations of the base claim and any intervening claims.
